Justice Bhushan Ramakrishna Gawai was sworn in as the 52nd Chief Justice of India on 14 May 2025.
Chief Justice of India BR Gawai said on Wednesday that the Constitution of India is at the top. The three organs of our democracy (judiciary, executive and legislature) work under the Constitution. CJI Gawai said that some people say that Parliament is supreme, but in my opinion the Constitution is paramount.
Justice Gawai, who was sworn in as the 52nd CJI of the Supreme Court, was speaking at his reception at hometown Amravati. CJI Gawai said that Parliament has the power to amend, but it cannot change the basic structure of the Constitution.
What people will say, it should not affect our decisions-Bhavai
CJI Gawai said that a judge should always remember that we have a duty, and we are the patron of the rights and constitutional values and principles of the citizens. We do not only have power, but we have also been put on a duties. No judge should walk with what people will say or feel about their decisions.
Chief Justice said- We have to think independently. What people will say, it cannot be a part of our decision making process.
Referring to the decision against Bulldozer Justice
The CJI said that he always let his decisions and work speak and always stood with the fundamental rights contained in the Constitution. Referring to his decision against bulldozer justice, he said that the right to shelter is supreme.
