The All India Muslim Personal Law Board (AIMPLB) has sent a memorandum to all political parties requesting that they take appropriate action in the matter of speech given by Justice Shekhar Yadav of Allahabad High Court (December 08, 2024) in the High Court campus.
AIMPLB general secretary Mohammad Fazalur Rahim Mujdidi on Thursday (June 26, 2025) to a letter to political parties said that Justice Yadav’s speech was under the guise of constitutionalism. The scholar judge has not only forgotten his position but has also disregarded the fact that in the concept of a secular state, the Constitution preaches every citizen to behave equally on the basis of their conduct. Many of them arise from their religion and culture, which place a place within the constitutional system and this is secularism in our country, not the definition of secularism on which the learned judge believes.
In the letter written about Justice Yadav’s speech, it was said on behalf of the board that common Muslims also feel that many religious practices are also necessary in mutual relations. The scholarly judges have forgotten that their religious consciousness which targets a particular religion will disrupt the rule of law under the guise of constitutionality.
‘He advocated his personal agenda’
The letter stated that being a member of a constitutional court, the judge advocated his personal agenda to promote a kind of constitutionality, which is unconstitutional in itself and which requires serious intervention from the system established within the Constitution.
The board believes that no effective action has been taken in this case for the last 6 months. It seems that the political class of our country has not taken this issue seriously. We have to remind all the political parties/class that the constitutional culture of India does not allow the judge to show the partisan attitude while holding the post of current judge as per 1950. Anyway, diversity and inclusion in our country does not allow a judge to be biased like Justice Yadav and hence it is necessary that political parties/classes should raise this issue within the process mentioned in the Constitution of India.
Justice Shekhar Yadav accused
In December 2024, Justice Shekhar Yadav condemned the Sharia law while supporting the Uniform Civil Code at a program organized by Law Cell of Vishwa Hindu Parishad. He had said that the system of the country will run according to the majority. Following the statement of Shekhar Yadav, he was accused of giving hatred speeches and inciting communal hatred.
