CJI Gawai said that Nagpur Bar Association is the most secular bar, which has members of all castes and religions.
Chief Justice of India BR Gawai said on Friday that judicial activism is necessary to maintain the constitution and the rights of citizens. This will remain, but it cannot be converted into judicial terrorism.
CJI said that the three wings of Indian democracy have been given their limits to the legislature, executive and judiciary. All three will have to work according to the law. When Parliament goes beyond law or rule, the judiciary can intervene.
CJI Gawai was speaking at the Nagpur District Court Bar Association program. During this, CJI Bhushan Ramakrishna Gavai shared some stories, in which he told about the struggles of his parents. CJI became a little emotional while talking about the influence of parents on his life.
CJI said- father also wanted to become a lawyer
CJI said, “I wanted to become an architect, but my father had a different dreams for me. He always wanted me to be a lawyer, a dream that he could not fulfill himself. My father dedicated himself to Ambedkar’s service. He wanted to become a lawyer himself, but he was arrested for his part of the freedom movement, so he could not fulfill his wish.”
Justice Gawai said that he lived in a joint family, which had many children and all the responsibility was on his mother and aunt. So to fulfill his father’s wish, he gave up his dream of becoming an architect.
Know what judicial activism and judicial terrorism
- Judicial activism or judicial activism: Judicial activism means when the courts, especially the High Court or the Supreme Court, move beyond their traditional scope and intervene in cases where the executive i.e. the government and the legislature i.e. Parliament/Assembly have been inactive or failed. That is, when the courts themselves take the initiative and give a decision on an issue, or give guidelines to the government, so that the rights of the general public are protected, it is called judicial activism.
- Judicial Terrorism or Judicial Terrorism: This is not a legal term, and using it is considered an insult to the judiciary. When a party believes that the court is not fair. Or the court repeatedly gives such orders that seem against a particular political ideology or group. When the court or judicial institution makes a party feel so that they are being intimidated, threatened or suppressed by their decisions or interference, some people in criticism are called Judicial Terrorism.
CJI Gawai’s father died in 2015
When my name was recommended for the post of judge in the High Court, my father said that if you remain a lawyer, you will only go after money, but if you become a judge, you will follow the path given by Ambedkar and do well for the society.
Gawai said, “My father also thought that his son would one day become the Chief Justice of India, but he did not survive to see it, we lost him in 2015, but I am happy that my mother is there.”
