- CJI Gavai Says Article 370 Went Against Ambedkar Vision of One Constitution for India

CJI BR Gavai inaugurated the Constitution Preamble Park in Nagpur on Saturday.
Supreme Court Chief Justice BR Gawai said- Article 370 was against the thinking of a constitution for the country of Dr. Bhimrao Ambedkar, Dr. Bhimrao Ambedkar. He said- Ambedkar advocated a constitution to keep the country united. Never supported the idea of a separate constitution for a state.
Gawai further said- Keeping the decision of the center to remove Article 370 giving special status to Jammu and Kashmir, the Supreme Court took inspiration from Ambedkar’s perspective of Akhand India under the ‘one constitution’. The Chief Justice said this at the inauguration of the Constitution Preamble Park in Nagpur, Maharashtra on Saturday.
CJI Gawai was part of the constitution bench of five judges headed by the then CJI DY DI Chandrachud, which upheld the center’s decision to cancel Article 370.
2 years ago, SC upheld the decision to remove 370 from Jammu and Kashmir.
On 11 December 2023, the Supreme Court upheld the Central Government’s decision to remove Article 370 from Jammu and Kashmir. The Constitution Bench of 5 judges of the Supreme Court had said – Article 370 was a temporary provision. It is clear from Articles 1 and 370 of the Constitution that Jammu and Kashmir is an integral part of India. All provisions of the Indian Constitution can apply there.

The Center removed 370 from Jammu and Kashmir on 5 August 2019. In a 476 -page judgment that came after 4 years, 4 months and 6 days, the court said, ‘We consider the President’s order issued to cancel Article 370. We also retain the validity of the decision to make Ladakh a union territory. Along with this, the Supreme Court ordered the assembly elections in the state by 30 September 2024.
