These constables had earlier challenged the decision of the Central Administrative Tribunal (CAT) in which their appeal had already been rejected. He appealed to the High Court to stay the B-1 test or clarify the status-order given on 30 August 2024.
However, a two -judge bench of Chief Justice Sheel Nagu and Justice Sumit Goyal clearly stated that CAT is a legal body and unless there is a legal flaw in its decision, the High Court cannot interfere in it.
With this decision, now these constables will also have to join the B-1 test along with new recruitment employees.

The High Court made these arguments:
- Just because the petitioners are old employees, they do not become the reason that they are exempted from the promotion test.
- It is not necessary that the High Court intervenes on every petition. When the tribunal has given the verdict according to the law, the High Court will not interfere with it.
- There are already two cases pending in the tribunal and the tribunal will soon take a final decision on them.
