Elon Musk is originally from South Africa. He was born in Pretoria. But he moved to Canada from South Africa in adolescence. In 1995, he shifted to America from Canada.
According to the Washington Post report, Musk received Canada’s citizenship in 1989. He started studying at Queen’s University in Canada and later moved to America in 1992. He went to America for admission to Stanford University, USA. But instead of completing his studies, he opened his first company ZIP2 in America.
Elon Musk came to America on a student visa (J-1 or F-1 visa). He came to America on a student visa for admission at Stanford University. There are strict conditions to work in student visas. Musk did not complete his studies in Stanford after getting a visa and started working on ZIP2, causing violation of visa conditions. Student visa holders are not allowed to work on startups without permission.
Then how did America’s citizenship get?
According to the report, Musk received the H-1B visa in 1997, which is given for work in select business. This visa allowed them to function validly in Zip2. It was said that Musk later obtained a green card. He became an American citizen in 2002 through the process of naturalization. The process usually involves residing for several years as a green card holder, giving a citizenship test and ensuring that the applicant has not committed any major crime or immigration violation.
Washington Post reported in 2024 that Musk did not enroll in Stanford in 1995 and started work on ZIP2, a violation of his student visa conditions. At the same time, the investors of ZIP2 were concerned about the immigration status of Musk in 1996 and had put a condition to the Musk and his co-founders to clear their status within 45 days. Failure to do so was cited to withdraw investment.
However, in a defamation case in 2005, Musk admitted in an email that he had no legal basis for living in the US other than applying to Stanford, indicating that he knew about his situation.
Experts say that Musk’s not enrollment in Stanford and working on Zip2 was technically a violation of their visa conditions. However, the immigration rules were not as strict in the 90s.
Can Musk’s citizenship be canceled and sent to them?
Naturalized citizenship can be canceled under the US law. For this, it has to be proved that important facts for citizenship were deliberately hidden and lied. If Musk hides information about his illegal work between 1995–1997 during his citizenship application process in 2002, his citizenship can be canceled theoretically.
For this, the government has to prove that Musk deliberately gave wrong information, which was decisive for his citizenship. If the citizenship of the Musk is canceled, then he will automatically become Canadian citizens, due to which he will be posted to Canada.
