The court was hearing a case in which the accused has been jailed for years, while the trial of the trial did not begin.

The Supreme Court that if a special court and separate infrastructure are necessary for a faster hearing of NIA (National Investigation Agency) cases. If not made soon, the courts will be forced to bail the accused.

A bench of Justices Suryakant and Justice Joymalya Bagchi said on Friday, “If the central and state governments do not form a special court for hearing on time, the courts will have no way but to bail the undertrary accused.”

The court was hearing a case in which the accused has been in jail for years, while the trial of the trial was not even started.

Court said- separate special courts required for fast hearing

The court said that separate special courts are necessary for sharp hearing in serious cases like UAPA and Mcoca. The court also expressed displeasure over the affidavit of the NIA secretary and said that it was not told what concrete steps the government should take to speed up the trial.

SC expressed concern over slow hearing in special cases

The Supreme Court had earlier expressed concern over slow hearing in special cases. The court said, “When a person has been in jail for years and the case has not started, then give bail or not, directly becomes a violation of Article 21 (personal freedom) of the Constitution.”
