The borders of India and Nepal are adjacent to themselves, the citizens of the two countries come to shop for each other to visit each other. Apart from this, many Nepali also do business in India, but the question is whether a Nepali citizen can get citizenship of India? And on what conditions can he get the right to vote in India? Let us tell you.
According to the Citizenship Act, 1955, any Indian citizen who voluntarily receives foreign citizenship would not be an Indian citizen on obtaining foreign citizenship. That is, if a person has citizenship of another country and wants to become a citizen of India, then he will have to give up citizenship of another country first. But he can take citizenship as a foreign national of India.
What is OCI?
If a person does not want to give up citizenship of another country and also wants to become a citizen of India, then he will be given foreign Indian citizenship (OCI), but this will not give them the right to vote in India. OCI means overseas citizenship of India, ie foreign nationals of India.
Two countries will get citizenship, but no right to vote
The Government of India has made a provision to provide foreign Indian citizenship (OCI). The Parliament of India approved the concerned bill in this regard in August 2005. A person of Indian origin of some categories who have migrated from India and have gained citizenship of any other foreign country other than Pakistan and Bangladesh, they deserve to provide OCI. Provided that their home countries allow dual citizenship in some form or the other under their respective national laws.
Individuals registered as foreign nationals of India will not have the right to vote or elected constitutional posts like Lok Sabha/Rajya Sabha/Assembly/Council, President, Vice President, Supreme Court/High Court Judge etc. If a person has citizenship of Nepal and also has foreign citizenship of India, then he will not be able to vote in India.
