The Gujarat High Court acquitted three people during the hearing on Monday. He was convicted in 2006 for the riots after the 2002 Godhra incident by the Anand Sessions Court.
The High Court, while delivering the verdict, said that the prosecution witness did not identify them. Nor did the witness mention the role of each accused seen in a crowd of more than 100 people.
Justice Geeta Gopi passed this order, accepting two appeals. One of the above appeals was filed by Sachinbhai Hasmukhbhai Patel and Ashokbhai Jashbhai Patel and the other was filed by Ashok Banarsi Bharatbhai Gupta.
The accused were also sentenced to five years imprisonment for Section 149 (shared objective of illegally gathering illegally) of the Indian Penal Code (IPC) and six months rigorous imprisonment for crime under Section 147 (riot).

Caution should be taken while accepting identity: Court The High Court said in the order- in cases where the accused is strangers for the witness. The lower court should take great care while accepting his identity. In the absence of Test Identification Parade (TIP), the accused’s identity in the dock will always be suspicious. It was not told how the captivity knew these 3 people. Nor did the witness tell about the correct role of these accused how he saw them in the crowd of 100-200 people.

Communal riots spread throughout Gujarat After the Godhra scandal, more than a thousand people were killed in the Gujarat riots in the Gujarat riots after the slain Godhra incident. Among them were 790 Muslims and 254 Hindus. A day after the Godhra incident, 69 people were killed by an uncontrollable mob at Gulberg Housing Society in Ahmedabad on February 28.
Among those who died were former Congress MP Ehsan Jafri, who lived in the same society. These riots worsened the situation in the state so much that the army had to be launched on the third day to control the situation. ,
