In 2019, Rahul Gandhi had to apologize in the Supreme Court in the case of contempt of court for a comment in the context of Rafale Deal itself. May, 2019 Rahul Gandhi, citing the Supreme Court, said, ‘Now the Supreme Court also accepted – the watchman is a thief’.
There was a period of general election in the country at that time, and the matter reached the Supreme Court. BJP leader Meenakshi Lekhi had filed a petition. Rahul Gandhi said in his apology, ‘He had no intention of insulting the court, nor did it deliberately do it … nor did he want to obstruct any kind in the judicial process of the court … I mistakenly made this mistake … so I want to forgive.’ The Supreme Court had accepted the unconditional apology of Rahul Gandhi.
About one and a half dozen cases against Rahul Gandhi are going on in various courts of the country. From Rashtriya Swayamsevak Sangh to Savarkar. The latest comment of the Supreme Court came during the hearing of a defamation case.
During the hearing of the case, the Supreme Court said to Rahul Gandhi’s lawyer, “… If you were a true Indian, then you have not said all this.”
Questioned true Indianness, but did not say what is true Indianness?
In the Supreme Court, Abhishek Manu Singhvi was advocating the case on behalf of Rahul Gandhi. Justice Dipankar Dutta’s question was, ‘Whatever you have to say, why not say in Parliament? Why do you have to say this in social media posts? ‘
Expressing disagreement with Rahul Gandhi’s statement, Justice Dutta asked, ‘Why are you making these statements without any evidence … If you were a true Indian, you have not said all this.’
Now the question arises that what is the true Indian? What should a true Indian be? What should a true Indian say? How much should a true Indian speak? What can a true Indian not express doubt? What kind of questions cannot be asked by a true Indian? The Supreme Court did not fix the definition of a true Indian. Just raised the question.
Rahul Gandhi has again stood in the dock of similar questions, and has come under the target of political opponents – but, the biggest question is that Rahul Gandhi also makes any difference with such questions?
This defamation case has also been recorded on a statement of Rahul Gandhi. During the India Address Yatra on December 16, 2022, Rahul Gandhi said, “People will ask about India’s journey, but China has captured 2000 square kilometers of Indian land, 20 Indian soldiers were killed, and our soldiers are being beaten in Arunachal.”
Uday Shankar Srivastava, former director of the Border Road Organization against Rahul Gandhi’s statement, had filed a defamation case in the MP-MP court in Lucknow. On May 29, 2025, the Allahabad High Court rejected Rahul Gandhi’s petition, and sent summons. Rahul Gandhi has challenged summons and complaints, saying that it has been lodged in a malicious manner and under the maliciousness. The Supreme Court has given great relief to Rahul Gandhi in the case. The proceedings of the defamation case have been stayed in the lower court, and have given three weeks for hearing. Also, notice has been issued to the complainant and the Uttar Pradesh government on the petition of Rahul Gandhi.
During the hearing of the Congress leader’s petition, the Supreme Court asked, ‘How did you know that China has captured the area of 2,000 square kilometers? Do you have any reliable information? Can you say all this when there is a dispute across the border? Why don’t you ask questions in Parliament?
There are more than a dozen cases of defamation
There are about one and a half dozen cases against Rahul Gandhi in courts across the country. In the famous cases, a Modi surname defamation case, in which the Supreme Court has stayed the sentence of two years from the trial court.
1. Modi surname case
Rahul Gandhi had commented on the Modi surname, targeting Prime Minister Narendra Modi at an election rally on 13 April 2019 in Kolar, Karnataka. Rahul Gandhi had said, ‘Why is Nirav Modi, Lalit Modi, Narendra Modi’s surname common? Why is Modi’s surname of all thieves? ‘
BJP leader Purnesh Modi had filed a criminal defamation case against him under Section 499, 500 of IPC for this statement of Rahul Gandhi. The lower court sentenced Rahul Gandhi to two years, and with immediate effect his Parliament membership was lost, but the Supreme Court stayed the sentence when the appeal was made. The court had said that as long as the case remains pending, the ban on punishment will remain intact.
2. RSS defamation case
This case is going on in Bhiwandi court of Maharashtra. RSS worker Rajesh Kunte filed a defamation petition against Rahul Gandhi in Bhiwandi Magistrate Court. Rajesh Kunte had alleged that in 2014, at a meeting in Bhiwandi, Rahul Gandhi had declared a guilty Rashtriya Swayamsevak Sangh for the assassination of Mahatma Gandhi. When Rahul Gandhi filed a petition against the case, the Supreme Court had said, if Rahul Gandhi wants to defend himself and is not ready to apologize, then it would be better to face the trial – and Rahul Gandhi is not apologizing and fighting the case.
3. Savarkar defamation case
Rahul Gandhi often makes statements against Vinayak Damodar Savarkar. Even after reaching Maharashtra during the visit of India, Rahul Gandhi raised the issue of Savarkar’s alleged apology from the British. In a rally in Delhi, he has said, my name is not Savarkar, Rahul Gandhi, I will not apologize.
Satyaki Savarkar of Savarkar’s family had filed a criminal defamation case against Rahul Gandhi. Satyaki Savarkar had submitted the charge to the court that Rahul Gandhi had made derogatory remarks against Savarkar in a public speech.
BJP leaders attacked Rahul Gandhi
Parliamentary Affairs Minister Kiren Rijiju has said, the Supreme Court has given strict messages and lessons to Rahul Gandhi. Kiren Rijiju on the social site X says, ‘If he does not even listen to the Supreme Court of India, then how can others control their useless things?
In its post of July 29, Kiren Rijiju wrote, one thing should be clear that there should be no confusion from the misleading erecents being spread by the Congress and the Left system regarding the boundaries of India … After 1962, China has not taken an inch land in Arunachal Pradesh.
By calling a press conference, BJP spokesperson Gaurav Bhatia said, “The comment of the Supreme Court raises questions on Rahul Gandhi’s credibility … How mature are he as the leader of the Congress party?” This is not the first time Rahul Gandhi has shown anti -India mindset.
