The Supreme Court on Monday canceled the policy of giving reservation for male and female officers in 2: 1 ratio to the Judge Advocate General (JAG) branch of the Indian Army.

JAG is the legal wing of the army, where officials look at legal advice, court-martial cases and legal needs of soldiers and their families.

Hearing the petition of two women candidates, the court said that this policy is arbitrary and violates the right to equality to all under the Constitution. SC said,

The government cannot reserve seats only for men. It is wrong to limit women’s seats. Real gender neutrality means the most eligible candidate to be elected.

Actually, two women candidates were at number 4 and 5th in the merit list, but they did not get a chance for women being only 3 seats. While male candidates with low marks were elected from them.

At the same time, the court ordered one petitioner to be included in the service immediately, while the other did not get relief as he joined the Navy during the petition.

The court said at least 50% seats for women for blessings

JAG was to be admitted in a total of 9 posts, in which 6 men and 3 women were selected on the basis of reservation in 2: 1 ratio. On this, a bench of Justice Manmohan and Justice Dipankar Dutta said that at least 50% seats should be given to women in the last years to get less opportunities to get less opportunities, but if women are in more merit than men, then it would be wrong to limit them to 50%.

The Delhi High Court on 6 August sought answers from the Central Government for not inclusion of women in the Indian Military Academy (IMA), Naval Academy (INA) and Air Force Academy (AFA) through CDS (Combined Defense Services) examination.
