The Delhi High Court on Friday advocated the implementation of the Uniform Civil Code (UCC) in the country. The court said that Personal Law gives child marriage permission, while the Poxo Act is the same crime in BNS. Given the repeated conflict between these laws, it is necessary to have a legally clear explanation.
Justice Arun Monga asked that we often get into a dilemma whether the society should be criminalized to follow the long -standing personal law.
Justice Monga said whether it is no time to move towards UCC. In which a structure should be created so that laws like personal law do not dominate national laws.
This comment of the Delhi High Court came to light during the hearing of the case related to the bail plea of Hamid Raza, accused of marrying a minor girl.
Hamid is accused under Section 376 of the IPC and the Poxo Act that he married a minor girl. The FIR was done by the girl’s stepfather against Raza.
However, the court said that in the current case, the minor was staying with Raza before Raza’s arrest. His father had an FIR to hide his crime. Hamid Raza was granted regular bail.
The country’s first state to implement Uttarakhand UCC
Uttarakhand Uniform Civil Code (UCC) has become the first state in the country to implement. It was announced by CM Pushkar Singh Dhami on 27 January 2025. Halala, polygamy, triple talaq have been completely banned in Uttarakhand since the UCC was implemented.
Uttarakhand is the first state after Goa, where UCC came into force. Even though the UCC is already applicable in Goa, it was implemented under the Portuguese Civil Code. Uttarakhand has become the first state to implement the Uniform Civil Code after independence.
