4 August 2025 After revealing the shocking incident of sexual harassment at Sri Sharda Institute of Indian Management at Vasant Kunj North Police Station in Delhi Murali accused Chaitanyand Saraswati alias Partha Sarathi of misbehaving with EWS girl students. The police recorded statements of 32 girl students in this regard. In which unwanted physical contact, objectionable messages and some employees of the institute came to light. Then raids were conducted in many places. Evidence and records were seized. Whose forensic analysis is going on.
The police have registered an FIR in this regard under sections 75 (2), 79, 351 (2) of the Code of India Justice (BNS). All these sections are based on sexual harassment, molestation, threats and fraud of the girl students.
BNS Section 75 (2)
This section says, ‘Any person who performs some act described in sections 75 (1), (i), (ii) or (iii) of section 75 (1), will be convicted and the person will be punished with the following punishment- Rigorous Imprisonment or Fine or both. That is, if the crime is related to physical contact, sexual proposal or showing pornographic material, then the court can impose a maximum of three years of jail or fine.
It is not necessary in this section that the act should be public. Private dialogues, messages, digital mediums etc. can also cause crime. This crime is considered cognizable if the defect is proved and can be arrest and court process. The court will keep in mind the seriousness of the case, evidence, role of the accused, etc. while fixing the sentence of the accused.
BNS (BNS) Section 79
Section 79 is as follows, ‘If a word, gesture or work is done by a person, so that a woman is intended to hurt the modesty, then she will be considered a crime. Physical contact is not necessary here. Words, vulgar comments, obscene gestures, etc. … who hurts the dignity of the woman is also a crime. The intention of the accused should be that the woman’s shame is disturbed by her statement or act- not only inadvertently or without the situation.
A person found guilty under Section 79 can have a jail or fine or both. This section has been considered a specified form of bail. That is, the accused is likely to get bail.
For example, making obscene comments on a woman in a public or private place. To make obscene gestures towards a woman. Chasing a woman or harassing her by messaging her repeatedly (if comment or gesture hurts the woman’s shame). Creating a woman’s picture/video and posting her in derogatory form, if her intention is to hurt respect.
BNS (BNS) Section 351
Section 351 is related to criminal intimidation. This crime inserts the following forms- trying to intimidate a person, threaten or force a task. Section 351 has four sub-sections (1), (2), (3), (4), which provides for different conditions and punishment:
– 351 (1): General Threats – Threatening to damage a person’s reputation, respect or security.
– 351 (2): Setting penalty for the offense of the said sub -section (1).
– 351 (3): Serious threats – Threatening to kill, kill serious injuries, damage property.
– 351 (4): Threatened from anonymous / unknown source- when the threatening who hides his name or address.
BNS (BNS) Section 351 (2)
Section 351 (2) says, ‘A person who is found guilty of the offense of Section 351 (1), can be imprisoned for up to two years and fines or fine.
This means that if a person threatens a normal level (which comes in sub -section 1), the maximum penalty can be a jail and fine up to 2 years. This crime is considered bailable. That is, the accused is likely to get bail. Anonymous/unknown threatening creates a special criminal situation, which can be punished severely.
How the case of sexual harassment came up
On 28 July 2025, the former student got a letter through email to IAF Group Captain. On August 3, 30 girl students complained to the monastery meeting. On August 4, PA Murali (Math Administrator) lodged a complaint with Vasant Kunj North police station. Statements of 32 girl students were taken, 17 of which accused hypocritical Baba directly. 16 statements were recorded in Patiala House Court.
