- 11 Year old student’s petition in the Supreme Court Says Entrance Exams in CM Shree Schools is Non Constitutional

11 -year -old Janmesh Sagar has approached the Supreme Court against entrance exam in CM Shri schools. Students say that the Delhi government’s policy to conduct entrance exam for admission in Class 6, 7 and 8 in CM Shri schools is wrong.
This writ petition, filed under Article 32, states that this entrance test is a violation of Article 21-A (free and compulsory education) of the Constitution and Section 13 of Free and Compulsory Education Act, 2009 (RTE Act). Section 13 of the RTE Act clearly prohibits any screening processor in school admission.
Class 6 student is Janmash
Petitioner Janmesh Sagar who is a Class 6 student in a government Sarvodaya Bal Vidyalaya in Delhi. Janmash applied for admission to CM Sri School for Academic Session 2025-26.
However, according to the notification issued by the Delhi government on 23 July 2025, it was mandatory to pass the entrance test, which was held on 13 September 2025.
The petition has argued that such examinations are illegal and discriminatory. CM Shri School is considered to be ‘specific category’ schools under Section 2 (P) of the RTE Act, and they have no exemption from the provisions of Section 13.
It was also said in the petition that the Delhi High Court had earlier said in a case that the RTE Act does not apply to specific category schools. But this interpretation is against the provisions of Article 21-A and Section 13 of the RTE Act. For this reason, the door of the Supreme Court has been approached directly.
Petitioner Janmesh has sought 3 instructions from the Supreme Court-
- It is announced that Section 13 CM of the RTE Act also applies to Shri schools.
- The cancellation of the notice of 23 July 2025 under which entrance examinations have been made mandatory.
- The admission is from the lottery system, not the screening process.
