The Supreme Court on Monday said that it is necessary to protect personal freedom, but the courts cannot ignore the suffering of the victims.
The Supreme Court made the comment by quashed at the Patna High Court’s March 2024 order in which two accused of murder were granted anticipatory bail.
A bench of Supreme Court Justice Vikram Nath and Justice Sandeep Mehta said that the High Court took this decision in a hurry and granted bail without listening to the complainant. The court did not consider it right.
The Supreme Court ordered that the accused surrender within four weeks and after that they can apply for regular bail.
The Supreme Court admitted that the High Court in this case took a serious crime like murder and granted bail without giving proper reason. The court said that this bail was not true at all, as the victim’s wife was killed in broad daylight.
The court said- Protection of personal freedom is necessary, but the courts will also have to see that the victim gets justice and security. It is necessary to balance between the two.
