The Calcutta High Court on Friday refused to accept the appeal of the West Bengal government challenging the sentence of life imprisonment by the lower court to the RG and the Junior Doctor’s rape-murder case at the Medical College and the Hospital, the guilty of the Junior Doctor’s rape case, Sanjay Roy refused to accept, While a similar petition of CBI was accepted.
Both the CBI and the state government had filed an appeal before the High Court demanding punishment-a-death for Sanjay Roy, the only convict in this case. A division bench of Justice Debangasu Basak and Justice Mohammad Sabbar Rashidi said that since the CBI had investigated and it was an prosecution agency, his appeal challenging the quantity of sentence is being accepted for hearing.
However, the bench refused to accept the appeal filed by the state government. The state government had argued before the High Court that apart from the central agency, it too could file an appeal claiming the inadequacy of the sentence given by the lower court.
The CBI claimed before the bench that since it is an investigation and prosecution agency of the case, it has the right to appeal to the High Court on the basis of insufficiency of punishment.

After this, the Calcutta High Court handed over the investigation to the CBI. The central agency filed a charge sheet in the lower court on 7 October and on November 4, charges were framed against Sanjay Roy. On January 20, the lower court convicted Sanjay Roy to life imprisonment by the end of his natural life.
Both the CBI and the state government appealed to the separate Calcutta High Court, in which the sentence given to Roy was challenged and the appeal of punishment-a-death was made for them. The bench reserved its order on both the appeals on 27 January. According to the former instructions of the bench, the victim doctor and the parents of the convict were represented before the court by their respective lawyers.
On the other hand, a new petition has been filed in the Supreme Court on behalf of the victim’s parents in the rape and murder case of the junior doctor. In which the matter has been requested to be re -investigated. Karuna Nandi, the lawyer of the victim’s family, has requested the CJI to hear this petition soon. However, the Chief Justice of the Supreme Court refused to hear the early hearing and said that he will decide the date for hearing the matter.
