The Kerala High Court said that in criminal cases including sexual offenses, it cannot be estimated that if the complainant is a woman, everything said to be true because nowadays there is a tendency to trap innocent people in such cases.

Justice PV Kunkrishnan made this comment with anticipatory bail to the accused of sexually assaulting a former female employee. The High Court said that in this case, the police did not investigate properly. The accused had said that the woman had abused her.

The court said, the case filed by the complainant cannot be investigated unilaterally. The police should hear the statements of both sides. Accordingly, the investigation should be carried forward.

The court said- If the complainants come out, take action on it In its order given on 24 February, the court said, nowadays there is a tendency to implicate innocent people in criminal cases with serious allegations of sexual harassment. If the police feel that the allegations of such women against men are false, then they can also take action against the complainants as the law allows it.

Be alert before handing over police investigation report The court told the police officials that during the investigation, one should be cautious and vigilant to find out the truth in criminal cases. Therefore, it is the police job to separate the straw from the grain before submitting the final report in criminal cases.

The accused himself complained of misbehavior against the woman. He also recorded the entire conversation. It was filled in a pen drive and handed over to the police.

The court said that in such cases, the complaint of the accused should also have been investigated. If a false case is found to be registered against the complainant (female) petitioner (accused), appropriate action should be taken as per the law. At the same time, the accused was granted bail with Bell Bond.
