Tamil Nadu Man Filed Divorce Case Madras High Court Said This Cannot Be Ground For Divorce | Husband said- ‘Wife sees pornographic film and …’, High Court said

Divorce Case: Most of the divorces in the court are given on the basis of mutual consent of husband and wife or to be tortured by either of the two. A separate case has come to light from Tamil Nadu regarding divorce, where the husband filed a divorce case in the court after watching the wife’s pornographic video. Regarding this, the Madras High Court said in its judgment, ‘Watching pornographic videos of wives cannot be the basis of divorce’.

According to the AFP report, the Madras High Court on Wednesday (March 19, 2025) gave this decision on an appeal made by a person in the High Court against the decision of the lower court. The High Court said, ‘Women also have the right to masturbate and they do not give up their sexual autonomy after marriage, so watching pornography cannot be considered as the basis of divorce’. The High Court refused to divorce.

‘Self -sighted is not a taboo fruit’
This case of a Tamil Nadu person was based on several acts of alleged cruelty from his wife, claiming that his wife was addicted to masturbation while watching pornographic videos. Rejecting the appeal, the Madras High Court while giving the verdict said, ‘Self -sighted is not a taboo fruit’.

‘The woman has a personal identity even after marriage’
The court said in its judgment, ‘When masturbation among men is considered universal, masturbation cannot be tarnished by women’. Also said that a woman maintains her personal identity even after getting married and her fundamental identity as a person is not affected by her marital status as a woman.

The Madras High Court argued that pornography addiction is bad and cannot be justified morally but it is not a legal basis for divorce. Divorce is forbidden in most parts of India where only one out of every 100 marriage breaks. Due to family and social pressure, people often have to maintain marriage even if they do not want to.
