The case is related to the 2022 assembly elections. Abbas was contesting from Mau on Subhaspa ticket. In a public meeting, Abbas had said- I have come to tell SP chief Akhilesh Yadav, no one will be transferred for 6 months after the formation of the government. Wherever it is, it will remain there. First there will be an account, then there will be transfer. At that time there was an alliance of Subhaspa and SP.
After this, an FIR of Hate Speech was registered in the city Kotwali. On 31 May, Mau’s MP/MLA court sentenced Abbas to 2 years in the case. The file reached Lucknow from Mau within 24 hours of the court order. Then on Sunday, (June 1), their membership was terminated by opening the Assembly Secretariat on the day of the holiday and the seat was declared vacant. However, the by -election was not announced.
Abbas’s lawyer Upendra Upadhyay said- on July 17, a petition was filed in the High Court against the sentence. Our demands were accepted by the court and stopped the sentence. A total of 5 trials were held in the case. The court reserved the verdict after the debate was completed on 13 August.
He said, we had argued that there is no criminal case on the content of the speech. The sections in which the punishment was done was not appropriate. This could have been a case of violation of the maximum code of conduct, which was unnecessarily converted into a criminal case.

The matter is from March 3, 2022. Abbas held an election rally at Paharpur Maidan in Mau. It said- who are running the stick here today. After this statement, the Election Commission then took action against Abbas Ansari and banned the campaign for 24 hours. On April 4, 2022, an FIR was lodged in the city Kotwali on the complaint of the then SI Gangaram Bind. Apart from Abbas, his younger brother Umar Ansari and election agent Mansoor, 150 unknown people were accused.
Abbas Ansari reached Mau Court on 31 May. He was kept in the library for a long time.
These were imposed on the IPC sections- 506 (threatened), 171F (interrupted election process), 186 (obstructing public servant), 189 (threatening public servant), 153A (communal disharmony) and 120B (conspiracy).

Mau court had said- there is no place for provocative speech in public service On May 31, the Mau court along with Abbas was also sentenced to 6 months in the case with his election agent Mansoor Ansari. Both were also fined 2-2 thousand. However, Abbas’s younger brother Umar Ansari was acquitted.
Justice Dr. KP Singh had said- There is no place for inflammatory speech in public service like political field. This becomes more serious when it means to direct and influence the election directly and in-directly.
After the punishment, Abbas and Mansoor took bail after filling a bail bond of 20-20 thousand. After this, when Abbas started going home, the police personnel stopped his car. It was said- stay for half an hour. Abbas had said on this- I am hungry since morning, I will come after eating food. The policeman replied- Do not cross the border of the district. Abbas turned back and replied- we are trapped ourselves, what else will we do to get trapped?
