The Chhattisgarh High Court has upheld the decision of the Family Court, in which the husband was allowed to divorce. The case was registered on the basis that the wife insulted the husband as ‘pet rat’ and repeatedly pressured her parents to leave. The court, considering it in the category of mental cruelty, justified the divorce order of the Family Court.
Actually, this matter is related to marriage in the year 2009. The couple also has a son. The husband alleged that in 2010 the wife left home and did not return. Only in 2011 met for some time. The husband filed a divorce petition in the family court in 2016, in which the wife accused of mental cruelty and abandonment.

In a message presented in the court, the wife wrote-‘If you leave your parents and stay with me, then answer, otherwise stop asking. The wife denied the allegations and said that she was emotionally and economically neglected. He also accused the husband of misbehaving and not responsible.
The Raipur Family Court revoked the couple’s marriage in 2019. The wife filed an appeal in the High Court against this order. A division bench of Justice Rajni Dubey and Justice Abhinage Kishore Prasad dismissed the appeal after hearing. The court said that the wife’s behavior and derogatory remarks became the cause of mental anguish for the husband. This behavior cannot be considered modest in terms of Indian joint family values.

At the same time, the court directed the husband to pay five lakh rupees to the wife as permanent maintenance (Alimani). This amount will be in addition to the earlier ongoing monthly maintenance. The court gave this order keeping the wife’s job, the responsibility of raising the son and the income of the husband.
This decision is considered an important example about the definition of mental cruelty in joint family system and marital life. The court clarified that pressurizing and insulting the husband to leave the husband is against family values ​​and can become the basis of divorce.
