The tenure of the current CEC Rajiv Kumar ends on 18 February. After this, Dnyanesh Kumar will take over.
The meeting led by Prime Minister Narendra Modi has approved the name of Gyanesh Kumar as the next Chief Election Commissioner. His term will remain till 26 January 2029.
He will take over after the retirement of the current CEC. Rajiv Kumar is retiring on 18 February.
At the same time, Vivek Joshi has been appointed as Election Commissioner. He is the Chief Secretary of Haryana and a 1989 batch IAS officer. At the same time, Election Commissioner Sukhbir Singh Sandhu will continue in his post.
Home Minister Amit Shah and Leader of Opposition Rahul Gandhi attended the meeting chaired by PM Modi. On the recommendation of this panel, a new CEC was appointed.
According to media reports, a list of 5 names was given for the new CEC. But Rahul refused to consider the names.
After the meeting, Rahul Gandhi issued a decent note. In this, he had said that the matter is pending in the Supreme Court, so this meeting should not have been held.
At the same time, the Congress had said- we cannot work in ego. The meeting was to be postponed so that the Supreme Court could decide soon.
Singhvi said- Government should wait till the hearing in the Supreme Court Congress leader and senior advocate Abhishek Manu Singhvi said that the CEC selection committee is a violation of the Supreme Court’s decision. By removing CJI from the committee constituted for selection of CEC, the government has made it clear that it wants control, not the credibility of the Election Commission.
Singhvi said that there is a petition in the Supreme Court on the new law made for the appointment of CEC and other EC. The case is heard on 19 February. This was just 48 hours of case. The government should have approached the Supreme Court for early hearing of the petition.
Hearing on petition challenging EC’s appointment on 19 February The Supreme Court will hear the petition challenging the appointment of CEC and EC on February 19. The case was to be heard on 12 February, but the case was not listed. Senior advocate Prashant Bhushan then raised the case in front of the bench of Justice Suryakant and Justice N. Kotishwar Singh.
Prashant had said that CEC Rajiv Kumar is retiring on 18 February. In such a situation, the government can appoint a new CEC, so the court should hear it soon. On this, the court gave the date of February 19 and said that in the meantime, if something happens, it will be subject to the decision of the court, so it is not a matter of concern.
The case is related to petitions challenging the constitutionality of the Chief Election Commissioner and Other Election Commissioner Act, 2023.

2 March 2023: Supreme Court verdict- It is necessary to include CJI in the selection panel On the appointment of CEC and EC, a 5 -member constitution bench of the Supreme Court said that a panel would appoint Election Commissioners. It will include the Prime Minister, Leader of Opposition in the Lok Sabha and CJI. Earlier, only the central government used to choose them.
This committee will recommend the names of CEC and EC to the President. After this the President will approve. Then they will be able to be appointed. The court also said that this process will remain in force until the Parliament enacts a law regarding the appointment of Election Commissioners.
21 December 2023: New Bill Pass related to appointment of Election Commissioners
The central government brought a new bill related to the appointment, service, conditions and tenure of CEC and EC. Under this, the Election Commissioners will be appointed as a panel of three members. It will include the Prime Minister, Leader of Opposition in the Lok Sabha and a Union Cabinet Minister. CJI was excluded from this panel. The bill passed in both houses during the winter session on December 21, 2023.
Opposition had objected to the new law On this law, opposition parties said that the government is weakening it by bringing a bill against the order of the Constitution Bench of the Supreme Court. Congress worker Jaya Thakur has filed a petition in the Supreme Court.
The petition said that Section 7 and 8 of the law violates the principle of independent and fair elections as it does not provide independent mechanism for the appointment of Election Commissioners. Amid this dispute, the Center appointed Gyanesh Kumar and Sukhbir Singh Sandhu as Election Commissioner in March 2024.
How many commissioners can be in Election Commission No number has been fixed in the Constitution regarding how much the Election Commissioners can be. Article 324 (2) of the Constitution states that the Election Commission may have the Chief Election Commissioner and other Election Commissioners. It depends on the President how much their number will be. After independence, the Election Commission had only the Chief Election Commissioner in the country.
On 16 October 1989, Prime Minister Rajiv Gandhi’s government appointed two more Election Commissioners. This made the Election Commission a multi-member body. These appointments were first made from the 9th general election. At that time it was said that this Chief Election Commissioner was done to cut off on RVS Perry Shastri.
On 2 January 1990, the VP Singh government amended the rules and again made the Election Commission a member body. On October 1, 1993, the PV Narasimha Rao government again approved the appointment of two more Election Commissioners through the ordinance. Since then, the Election Commission has two Election Commissioners with the Chief Election Commissioner.
