Complainant Payal, who is a resident of Sector-47C, Chandigarh, said that he was going to take the exam at Gujarat Flying School, Vadodara. For this, he booked tickets from Delhi to Ahmedabad from SpiceJet. But during the journey, his belongings were sent to another place, causing him to face a lot of trouble.
After hearing the case, the court admitted that due to the negligence of the airlines, the service of the complainant was interrupted and SpiceJet would have to pay damages.
If reached Ahmedabad, the goods were not found
According to the complainant, he traveled from Delhi to Ahmedabad on the due date, but when he reached Ahmedabad, he saw that his belongings were missing. When he gave immediate information to the airlines staff, he was asked to file irregularity report (IR).
Payal said that he was supposed to leave for Vadodara immediately, but due to lack of goods, he had to leave for Vadodara Airport without a taxi. The next day he was told that the goods were accidentally sent to Bangalore and will be returned in 2 days.
Airlines clarified, court did not accept
SpiceJet Airlines said in response that it is not responsible for delivery of passengers or luggage. The Airlines cited Rule 13 (3) of the Air Transport Act, 2012 and said that if the goods have been returned within 7 days, the service cannot be considered a decrease. He claimed that the complainant was returned to the goods within two days, so he is not eligible for compensation.
However, the Consumer Court dismissed the arguments of the airlines and admitted that the passenger had to go to Vadodara without luggage, causing him a huge inconvenience. The court said that this is a case of negligence in the service, and due to this the victim had mental problems.
