CJI and Nalsa Initiative for Mutual Settlements: A unique initiative is being taken to settle the cases with mutual agreement. Chief Justice B. R. Justice Surya Kant, president of Gawai and National Legal Services Authority (NALSA), has agreed to the campaign called ‘Mediations for Nation’. This campaign will run across the country for 90 days.
Campaign will run to resolve pending cases in court
The purpose of this campaign, which starts from July 1 to September 30, is a solution to pending cases from Tehsil Court to High Court. Also, its purpose is to bring arbitration to every corner of the country. So that people adopt arbitration as an easy, friendly and effective dispute resolution process.
In which cases will be mediation
The kind of cases that will be selected for mediation include marital dispute, accident compensation case, domestic violence case, check bounce case, commercial dispute, service dispute, compoundable (compromise) criminal cases, consumer disputes, loan recovery cases, ancestral property disputes, eviction cases, land acquisition disputes and other civil cases.
Court will decide the possibility of agreement
The cases which will be identified will be given a place in the Special Cause List (hearing list) of the concerned court from July 1 to July 31. The cases in which the court will see the possibility of agreement will be sent for mediation.
Campaign will continue seven days of the week
It has been told by Nalsa and Mediation and Conservation Project Committee (MCPC) that trained intermediaries will be included in this campaign. This campaign will continue all 7 days of the week.
Apart from this, the convenience of the parties will be taken care of to make the campaign a success. According to their wish, arbitration will be done offline, online or hybrid, in any way.
