CJI BR Gawai addressed the Independence Day program of the Supreme Court Bar Association.

Chief Justice of India (CJI) BR Gawai said that the Supreme Court is not bigger than the High Court in the collegium system. Both are constitutional courts and none of these are neither bigger than each other nor small.

He clarified that the collegium of the Supreme Court cannot recommend the special name to the High Court collegium for the post of judge. Justice Gawai was speaking at the 79th ceremony of Independence Day by the Supreme Court Bar Association (SCBA) today.

On this occasion, SCBA President Vikas Singh said that lawyers practicing in the Supreme Court should also be considered to make judges in the High Court, even if they have not practiced there.

CJI Gawai said that the first responsibility of the appointment of judge is with the High Court Collegium. The Supreme Court can only suggest the name and request the High Court to consider the names. Only after the consent of the High Court, they reach the Supreme Court Collegium.

Gawai said- no case is small

In his address, CJI Gawai recalled the heroes of the freedom struggle and said that freedom was not just a political movement, but it was also moral and legal conflict in which lawyers played a big role. No case is small, which may seem modest for one, it can be a question of life, respect or existence for another.

Gawai said that it is the responsibility of the judges to make such interpretation of the law so that the rights of the underprivileged are reserved and the rule of law is strong. He mentioned several stages of the freedom movement and the heroes Santhal Rebellion, Birsa Munda, Jyotiba and Savitribai Phule, Rabindranath Tagore, Mahatma Gandhi and Bhimrao Ambedkar.

Gave the example of President and Santhal community

He told the example of President Draupadi Murmu that the Santhal community, who first revolted against the British in 1855, has reached the highest constitutional post of the country today. He said that this journey shows that India has come a long way, but the work of creating a fair, equal and inclusive India is still pending.
