The Delhi High Court has issued a notice to the Central Government, Delhi Government and Delhi Police on a public interest litigation filed by the delivery partners of e-commerce and Quick Commerce platforms in the capital in the case of alleged violation of the Motor Vehicle Act and traffic rules.
Chief Justice D.K. in Delhi High Court The bench of Upadhyay and Justice Tushar Rao Gedela issued a notice to the National Highway Authority, Delhi Transport Department and Delhi Police Commissioner and fixed the next hearing on 8 October.
Petition filed in Delhi High Court
This petition has been filed in the Delhi High Court by advocate Shashank Tripathi, alleging that the delivery boys of fast growing e -commerce and quick delivery services in Delhi are constantly violating the delivery boys, comprehensive and untreated motor vehicle laws and rules.
At the same time, the Delhi government’s lawyer in the Delhi High Court told the court that the government has already notified the Delhi Motor Vehicle Agricultural and Delivery Services Scheme 2023 for two -wheelers on 21 November 2023. On this, the court directed the Delhi government to present this policy on record and also tell what action has been taken so far under this policy.
Delivery employees are violating rules
The petition filed in the Delhi High Court states that many delivery employees carry excessive and large sized goods on motorcycles and scooters such as industrial equipment foldable furniture and commercial size delivery boxes, which are much higher than the prescribed limit under traffic rules. This not only affects the stability of the ride, but the sight of the drivers is interrupted and the safety of the general public is threatened.
Crisis on traffic rule and road safety system
The petition filed in the Delhi High Court also said that if these unprotected delivery practices were ignored, then other commercial institutions will also be allowed to ignore the rules and there will be a crisis on traffic rule and road safety system in the entire city.
The petitioner has demanded from the court that a guideline should be made for delivery services in Gig Economy and all concerned companies should be instructed to operate their services under the Motor Vehicle Act and Central Motor Vehicles Rules.
