The bench of Supreme Court Justices Pankaj Mithal and Ahsanuddin Amanullah heard the arguments of lawyers of Tahir Hussain and Delhi Police for about 2 hours. Justice Mithal refused to grant bail to Tahir considering the seriousness of the allegations against him. At the same time, Justice Amanullah said that no matter how serious the allegations are, at present they are just allegations. In such a situation, the petitioner should be granted interim bail for election campaign. Justice Amanullah asked to grant interim bail to Tahir till the morning of 4th February.
Now a bench of 3 judges will hear
After the completion of the decision of both the judges, the Chairman of the Bench, Justice Pankaj Mithal directed the Registry to now place this matter before the Chief Justice, so that he can form a bench of 3 judges and get the matter heard.
More than 50 people were killed in Delhi riots
More than 50 people lost their lives in the 2020 Delhi riots. Tahir Hussain is accused of playing an active role in the riots. He is also accused of getting IB officer Ankit Sharma murdered. He has got bail in 8 cases of riots. But he has not got bail in the Ankit Sharma murder case. Earlier, Delhi High Court had allowed Tahir Hussain to come out on custody parole and file his nomination. But he was refused bail for election campaign.
However, even if Tahir Hussain gets interim bail in the Ankit Sharma murder case, it will still be difficult for him to come out. There are also 2 cases of PMLA and UAPA against him. In these cases he has not got bail from the lower court.
