Demand to consider child as an OBC based on mother’s OBC certificate, Supreme Court ready for detailed hearing

The Supreme Court will make a detailed hearing on the issue related to issuing OBC certificates to single mothers of single mothers. In the petition, the system of giving certificates to the child has been opposed only on the basis of OBC certificate of the father side. The Supreme Court has said to hear the case on 22 July.

Santosh Kumari, who hails from Delhi, says that if mother is OBC and she is following the child alone, then the child should also get OBC certificate. On 31 January, the court sought a reply from Delhi and the Central Government on the petition. Now given the importance of the matter, other states have also said to listen.

The petitioner says that giving OBC certificate only on the basis of ancestral side is a violation of constitutional rights. Such arrangements are not applicable for SC/ST. In such a situation, the OBC class discrimination against the children of single mothers. If an OBC woman has adopted the child, how can she give the caste certificate of the father?

In the hearing held on Monday, a bench of Justice’s Vishwanathan and Justice N. Kotishwar Singh expressed surprise on how the matter was put in front of a vacation bench. Justice Vishwanathan said that it is definitely an important subject. A detailed hearing is required on this. Other states should also be heard on this.

The court also said that if a woman is divorced, it would not be right to ask her to ask for help from the ex -husband to get her child’s caste certificate. The court said that the state governments should also prepare the answer to the question that if the wife is not OBC from the married couple, then the child does not get the OBC certificate? The judges also cited a court decision, which has also been asked to give caste certificate to the child on the basis of SC/ST certificate of mother.
