More than five and a half hundred prisoners in the country are currently in jails waiting for the death sentence. It has been many years or decades of punishment for many of them. More than a hundred convicts are heard hanging almost every year. But due to some reason or the other, the sentence keeps postponing. On the one hand, old decorating are pending, on the other hand, in Gujarat, a double capital punishment was heard for the rape and murder of the girl child. Know, what is this and why this kind of sentence is sentenced.
A court in Anand district of Gujarat sentenced a person to death twice in the 2019 case. The case was of rape and murder of a seven -year -old girl. The Khambhat Sessions Court sentenced the convict under Section 302 and Section 6 of Poxo. Describing cruelty with the girl, the court also asked the court to give 13 lakh compensation to the victim’s family.
What is dual death sentence
It is given in very cruel cases. Such as barbaric murder or rape, or rape with children. Dual death sentence suggestions that even if the guilty is acquitted in a crime in the High Court, he can get the death penalty in another case.
In this regard, Karkardooma Court lawyer Manish Bhadoria says that there are many sections, in which there is a provision for hanging. Sexual misconduct of children comes in this category. When an accused prosecutes, the court gives separate judges on different crimes. Like death sentence twice in double murder. Many times these decorations run together, and sometimes they are also given in pieces. In the relevant case, the convict raped and murdered the girl and in both cases she was punished.
Now the question here is how can two hanging sentence be found? Apparently this is not possible, but such a judgment is given to tell the seriousness and sensitivity of the case. That is, it is symbolic.
Another thing often arises that people remain in jail for years even after being hanged, or how many times the sentence is reduced and life imprisonment is also done? So the reason behind this is the inverted pyramid style of our courts. After the trial court gives the verdict, he sends it to the High Court, where the cases are seen afresh within a month.
Usually, the High Court sessions approves the court sentence, and can be punished. But often only then comes the guilty appeal, and the matter moves to the Supreme Court. Many times the hearing is so long that the court melts.
Here the rules of Natural Justice are cited that the convict suffered a fear of death sentence every day while in jail, which is no less than death sentence. Therefore, such prisoners show life imprisonment by showing softness to such prisoners. The National Law University report in Delhi ‘Death Penalty in India …’ says that the decision to hang becomes a long legal battle that usually drawn for 20 to 22 years.
Many times, even if all the courts come in a rhythm, the President has the option of mercy petition. If a petition is accepted, there is an option to decrease the punishment to reduce. This is the reason that in the last two and a half decades, more than 90 percent of such cases were reduced.
Apart from us, there are many countries in the world, where multiple death verdicts are given, such as in cases like terrorism, rape and murder. But the difference is that even after the death sentence, the prisoner spends 20 years in jail, while the process in other places is faster and more strict. For example, if we talk about Iran or Saudi Arabia, or in just a few weeks, a decision is made to decide.
