A two -member bench of the Supreme Court, Justice Sanjay Karol and Justice Ehsanuddin Amanullah ordered the accused to be released on bail after hearing the arguments of senior advocate Nitya Ramkrishnan in defense of the accused.
Other cases were given
During the hearing, senior advocate Nitya Ramakrishnan argued before the court that the accused is in jail for the last three years and most of the accused named in the case have been granted bail. Therefore, the accused should also be granted bail on the basis of equality and in view of the allegations made by the prosecution.
Allegations of forcibly converting
The senior advocate also told the court that cases were registered in Vadodara and Bharuch on charges of forcibly converting the accused, out of which the accused in the Vadodara case has already got bail. Since the allegations in the Bharuch case are also of the same nature, the accused should be granted bail.
Bail has been rejected three times
However, the government lawyer strongly opposed the bail to the accused and told the court that the accused has been rejected once from the Supreme Court and the trial court, while his bail has been rejected three times from the Gujarat High Court. . Therefore, it is unfair to file a bail petition repeatedly on behalf of the accused because there has been no specific change in the case of the case.
Was intimidated and threatened with money greed
Government lawyer Rajat Nair further told the court that the accused is the main accused in the case, who is accused of misusing the money of ‘Betul Mall’ and has a serious charge of converting the poor people of the weaker sections of the society by giving them money by giving them money. The government lawyer also said that the accused not only lured the money, but also intimidated and threatened, due to which a case was filed against him.
The complainant’s lawyer protested against bail
Along with the government lawyer, the counsel of complainant Praveen Bhai Vasant Bhai also opposed the release of Sajid Bhai Patel on bail, but the court ordered the plea to give conditional bail to petitioner Sajid Patel, agreeing with the arguments of senior advocate Nitya Ramakrishnan. . The Supreme Court directed the lower court to set the conditions of bail for Sajid Patel on the lines of other bail accused.
