The High Court has stayed the hearing going on in the District Court in the Jama Masjid case of Sambhal. During the hearing on Wednesday, the High Court has sought answers from all the parties in this case within 4 weeks. Based on the response of the parties, the Mosque Committee will submit its rejoinder within two weeks.

Actually, the arrangement committee had filed a petition on behalf of Jama Masjid on January 4. In this there was a demand to stop the survey. The Muslim side has got immediate relief as the High Court has stayed the hearing of the case going on in the district court. The case was heard in the High Court on Wednesday, January 8 in the single bench of Justice Rohit Ranjan Aggarwal.

During the hearing, the High Court stayed the decision of the lower court. The court said- no action will be taken till further orders. Senior advocate Harishankar Jain and advocate Prabhas Pandey argued on behalf of the Hindu side. Whereas SFA Naqvi presented his position on behalf of the Muslim side.

In fact, after the survey and then violence in November, the Muslim side had filed a petition in the Supreme Court. The Supreme Court had directed the Muslim side to file a petition in the High Court. Also, the High Court was directed to hear the petition as soon as possible.

The petition filed by the Muslim side. In it, he raised questions on the maintainability of the case going on in Sambhal District Court and demanded its cancellation. Besides, the advocate commissioner’s survey report was not made public and a stay was also demanded on the process of civil court’s survey order.

The Hindu side is claiming that there is a Harihar temple in the royal mosque of Sambhal. A petition was filed regarding this.

What is the controversy of Jama Masjid of Sambhal? The Hindu side has been claiming for a long time that there was a temple on the site of Sambhal’s Jama Masjid. On November 19, 8 people reached the court regarding the matter and filed a petition. Among them, Supreme Court lawyer Harishankar Jain and his son Vishnu Shankar Jain are prominent. Both of them are also looking into the matters of Taj Mahal, Qutub Minar, Mathura, Kashi and Bhojshala.

Apart from these, the petitioners include the names of lawyer Partha Yadav, Mahant Rishiraj Giri of Banana Temple, Mahant Dinanath, social workers Vedpal Singh, Madanpal, Rakesh Kumar and Jeetpal Yadav. The Hindu side claims that this place used to be the Shri Harihar Temple, which was demolished by Babar in 1529 and converted into a mosque.

The Hindu side filed a petition in the Sambhal court. In the 95-page petition, the Hindu side has made the basis of two books and a report. These include Baburnama, Ain-e-Akbari book and a 150-year-old report of the Archaeological Survey of India (ASI).
