High Court Order Non-Family Transfer 3 Years Quarter | Relief to central employees from Punjab-Haryana High Court: If transferred to non-Family station, you will get quarters for 3 years, central government’s petition dismissed-Chandigarh News

The Punjab and Haryana High Court has clearly stated that if a central employee is transferred to the non-Family station (where the family cannot live), it can keep the government quarters on low rent for 3 years after every transfer. This decision came in the case in which

Petitioner Joint Director (Contracts), Chief Engineer Office, Chandigarh Zone, Military Engineering Services, were employed in the Ministry of Defense and who were transferred in 2015 and Udhampur in 2018 and Udhampur (both non-Family Station).

The court said that it has not been written anywhere in the regulations of 2017 by the government and the orders of 2018 that only the first transfer will be exempted. If an employee is being sent to non-family station repeatedly, then every time you will get the right to keep a quarter for 3 years.

Government’s double attitude is not good

The government recovered a fine from an employee while it was allowed to keep the house. The court said, “The government says on one side that there is a 3 -year discount and on the other side says that the employee did not vacate the house, so pay the fine. Such a double attitude will not work.”

Order to return the amount of relief to the employee, the case was of a government official who was posted at Leh in 2015 and then in 2018 at Udhampur (both non-family stations). He remained in the government quarters till December 2020.

The court said that it did not do any wrongdoing and the government would have to pay a fine from July 2020 to December 2020 and return its interest.

That’s why the court exempted

The court said that employees living at non-Family station have to face many problems like-

  • Fiery cold
  • Lack of children’s education
  • No hospital or treatment facility
