The matter is on 31 March 2018. Advocate Narendra Tiwari bought 3 pouches of 10–10 rupees of evening buttermilk from Reliance Fresh Store at Trade Center. Instead, 35.28 have been taken from them. Tiwari immediately objected, but he was not returned from the counter. When the bill was shown, the operator said that this is the rule. The more money taken here is mentioned. They have been charged the right price and refused to return Rs 5.28. He filed a case in the Consumer Forum. The case, which lasted for seven years, was heard 40 times. Now the forum has ordered that Reliance Fresh and Sanchi Milk Union should return Rs 2.64-2.64. Also give 3,000 rupees for mental harassment and Rs 2,000 for case expenses.
Tiwari said that the question is not worth Rs 5.28. Many stores take more money from customers in this way, but they do not pay attention and are cheated. Through this case, people have to bring awareness, so that they remain conscious of their rights.
Advocate made a complaint in the Consumer Forum with all evidence, including the bill.
Response not received from landline and toll free number
Tiwari made calls on Sanchi’s landline phone number and toll free number, but could not be contacted by being busy. He then issued notices to Indore Cooperative Milk Union Maryadit (Sanchi), Indore and Reliance Fresh but both did not respond.
Then on 3 April 2018, he made a written complaint to the measurement weighing department. There was no response from there either. He finally took refuge in the Consumer Forum on 4 April 2018. In this, Indore Milk Association and Reliance Fresh were made party.
The agency argued – not the name of the customer on the bill
Tiwari says, Reliance Fresh tried to prove me a liar in front of the forum. It was said that the name of the buyer on the bill is not the name (Narendra Tiwari). In such a situation, he does not fall under the category of consumer. He tried to spoil the credibility of our outlet. It was also argued that the receipts of weight slip, tulwai, date etc. have not been submitted by the measurement department or documents of action.
It was also argued that the price printed by Indore Milk Association is inscribed with blue ink. In such a situation, there has been no shortage of any kind in service from Reliance. Appealed to dismiss the claim with these arguments. The outlet could not even prove what is 5.28 rupees. Said that there is a different charge.
No one was introduced by Sanchi
In the case, the forum summoned Indore Dairy Association and Reliance Fresh for hearing. No one was present on behalf of Indore Dairy Association in this. The forum took a unilateral decision on this and started hearing between Reliance Fresh and the aggrieved side.
In this, the same arguments were made by the Advocate of Reliance Fresh, which the outlet operator gave on the spot. He said that Rs 5.28 is a separate charge which has been imposed correctly.
Pouched empty pouches and bills of buttermilk
The bill of the buttermilk purchased by Tiwari, the empty pouches after using it, were presented in the forum of the complaint made to the weighing department. He argued that the price that was kept on the buttermilk pouches was to be recovered or the high price recovery by Sanchi and Reliance Outlets was to be mentioned on the pouch.
More than 40 times appearance, justice found
Tiwari says that he was produced 40 times in seven years. The second muscle usually takes two to three months after one muscle. The second reason was from 2019 for about two and a half years. The forum holds a hearing in the presence of Judicial Chairman and two members. Many times the post is also empty, due to which the hearing goes on.
