In this case of gangrape, the sharp noise between TMC MP Kalyan Banerjee and Mahua Moitra is a danger bell for any party, the party and the government also reveal what is the attitude of women towards women.

The kind of statements that TMC MP Kalyan Banerjee has made in defense of rape accused, how much his thinking towards women has fallen, shows others to what level they can go to to prove their point right. What can a person who can say anything about a woman MP of his own party can expect about women’s crimes?

After the incident surfaced, the statements of TMC’s senior MP Kalyan Banerjee and MLA Madan Mitra gave rise to controversy. Banerjee tightened up and said that Mahua Moitra has returned to India from a honeymoon of one and a half months and has started fighting with me as soon as he comes. Therefore, hardly any civilized society will consider Banerjee’s words to forgive. Banerjee’s personal life, especially his marriage and age difference, was inappropriate and personal. It should be seen as an attempt to divert attention from the rape case.

Is legal action possible for this?

The nature of Kalyan Banerjee’s comments, potential legal basis, and possibilities of action must be evaluated under the purview of Indian law. Only then will you get rid of such a trend. Section 356 of the Indian Justice Code (equivalent of IPC Section 499/500) defines defamation, which gives a false or derogatory statement with the intention of hurting someone else’s reputation, so it includes criminal defamation (sentenced to 2 years or fined or both) and civil defamation. Banerjee’s statements, such as a 40 -year -old family broke and interest in earning money, is going to harm Moitra’s social and political prestige. Therefore, it can clearly become a case of criminal defamation.

Provision: BNS Section 79 (equivalent to IPC Section 509) considers words, gestures, or actions that hurts the dignity of a woman, including punishment and fines up to 3 years. Banerjee’s comments, such as Moitra’s marriage and comments on personal life, can be considered to hurt their dignity. Extensive negative reactions on social media are enough to support Mahua’s claim.

Both Banerjee and Moitra are Lok Sabha MPs, and Banerjee’s statements may be a violation of parliamentary dignity. The Lok Sabha’s Ethics Committee can investigate the matter, especially because Banerjee mentions Moitra’s expulsion of 2023, which can be considered as an abuse of parliamentary privilege.
