On January 20, Sealdah Court sentenced convict Sanjay Roy to life imprisonment.
The Calcutta High Court on Friday heard RG and heard the case related to the rape case. The court dismissed the petition of the West Bengal government and accepted the CBI’s petition.
Both challenged the conviction of convict Sanjay Roy for life imprisonment from the lower court. Both petitions demanded death penalty for Sanjay.
A bench of Justice Debangsu Basak and MD Sabbar Rashidi told the Bengal government that the state government does not have the right to demand punishment-a-death.
The court, while giving a verdict in favor of the CBI, said that it was an prosecution agency, so it had the right to challenge the term of the sentence.
Sealdah Court sentenced Sanjay Roy to life imprisonment on 20 January. The hearing on 27 January was reserved by the Calcutta High Court.
Trainee doctor was murdered after raping a trainee doctor on the night of 8-9 August 2024
The RG Kar Hospital was raped on the night of 8-9 August. The doctor’s body was found in the seminar hall on the morning of 9 August. Based on the CCTV footage, the police arrested a civic volunteer named Sanjay Roy. Demonstrations took place across the country including Kolkata regarding the incident. Health services were stalled in Bengal for more than 2 months.
The victim’s family does not want to hang the convict
Earlier on 27 January, the victim’s parents gave a statement in front of the High Court. Parents had said that we do not want the convict to be hanged. The victim’s parents had said- our daughter lost his life, it does not mean that Sanjay’s life is also lost.
Dainik Bhaskar questioned the victim’s parents and their lawyers- earlier you were in favor of hanging the guilty. Now what happened that you have turned against hanging Sanjay Roy?
Advocate Gargi Goswami said that the victim’s family has no right to go to the High Court yet. After listening to the CBI and the state government, the court asked if the victim’s family wants the death sentence. Then we told that he does not want the death penalty.
Case not in rarest of rare category
The Sealdah Court convicted Sanjay on 18 January. Justice Anirban Das gave a 160 -page verdict on the 164th day of the incident on the sentence on 20 January. Das had said in the judgment that the matter has not been hanged in the rarest of rare category. The CBI and the victim’s family had sought a death sentence.
