In Bihar, there is already a political struggle about the special intensive revision i.e. SIR being run by the Election Commission. Now former Deputy Chief Minister and Leader of Opposition in the Assembly, Tejashwi Yadav, has a case of having two voter cards. The Election Commission has written a letter on Sunday asking RJD leader Tejashwi to give details of the voter ID card (EPIC) number.
Tejashwi has two voter cards
Tejashwi had alleged on Friday that he is not named in the state’s voter list draft and his name is missing from the voter list draft published on August 1, 2025. However, this claim has been rejected by the Commission and the details of other voter cards have been sought from them. The Commission released the Voter List draft, although his EPIC number was different, describing the claim of RJD leader Tejashwi as baseless.

Tejashwi Yadav claimed at the press conference that he had voted with the voter card of EPIC number Rab2916120 in last year’s Lok Sabha elections, which is now missing from the draft role. Instead, Tejashwi’s name is recorded with EPIC number Rab0456228 in the list of Election Commission. Now only the difficulties of Tejashwi have increased about this, because they have two voter cards.
Two separate EPIC Number
Tejashwi Yadav is a voter of Digha assembly seat in Bihar, but as an MLA in the state assembly, he represents the Raghopur assembly seat. The Electoral Registration Officer (ERO) of Digha constituency wrote a letter to the RJD leader saying that during the investigation, it was found that your name is recorded on serial number 416 of polling station number 204, whose EPIC number is Rab0456228.
During his press conference, Tejashwi filled his EPIC number Rab2916120 on the official website of the Election Commission and captured it in front of the journalists present there, making the journalists come to know that their number was missing. Tejashwi then accused the Election Commission of working for the BJP and asked the Election Commission that when his name is not in the draft voter list, how will he contest the upcoming assembly elections.
The NDA leaders have appealed to the Election Commission to take cognizance of two voter cards of Tejashwi Yadav and register a case against him. The leaders of the BJP and all its allies in Bihar clearly say that where the two voter cards came from Tejashwi, it is a crime to have two voter ID cards.
What is the law to say?
A person in India has a lawful crime. This is considered a serious violation under the Public Representation Act, 1951. Keeping two voter ID cards can lead to legal action against a person, which can include fine, jail or both. Apart from this, it can also affect the ability of a leader like Tejashwi Yadav to contest elections.

According to the rules of the Election Commission, one person’s name can be recorded in the voter list of only one assembly constituency. It is illegal to keep more than one voter card or to have two different voter ID cards (EPIC number) in the name of the same person. Under Section 17 and 18 of the Public Representation Act, 1951, one person cannot be named in more than one voter list.
Voter right can be suspended
Keeping two voter ID cards is considered a duplicate entry in the voter list, which is illegal. Under Section 31, if a person gives incorrect information in the voter list or presents fake documents, then it is considered a crime. If the second voter ID card is made by giving fake documents, then a jail or penalty can be legally imposed.
If Tejashwi is found guilty of keeping two voter ID cards, it proves that he has made another voter ID card illegally, then it will be considered a serious electoral offense. In this case, his voting right ie the right to vote can be suspended and legal action can be taken against him.
The Election Commission ensures that there is no duplicate entry in the voter list under any circumstances. If a person keeps two voter ID cards, the Commission examines it and starts the process of removing duplicate entry. Also, if forgery is found, legal action is taken.
ECI gave signs of fraud
The EPIC number from which Tejashwi Yadav’s name is recorded in the voter list of the Election Commission, is different from the voter card, which Tejashwi himself showed in a press conference. Now BJP and JDU have accused Tejashwi of keeping two voter ID cards. The BJP called it an ‘election scam’ and demanded the Election Commission to file a case against Tejashwi and suspend his voting rights.
The Election Commission has issued a notice to Tejashwi in this case, in which he has been sought a reply in the case of two voter ID cards. The Commission has expressed suspicion that the second EPIC number (Rab2916120) may be fake or may have been made illegally, as it was not found in the last ten years records. Tejashwi’s name is recorded in front of EPIC number- Rab0456228 in the Election Commission records.

Now Tejashwi Yadav will have to respond to the Election Commission notice, how he got two voter ID cards. Then the Election Commission will investigate their reply and check its record. If it is proved that Tejashwi deliberately placed two voter ID cards or used fake documents, then it can be very difficult in front of him.
Danger of cancellation of candidature
Under the Public Representation of Representation Act, the candidate’s candidature can be canceled or disqualified from contesting elections temporarily if the election fraud or misinformation is given. If the voter proves to be a fraud in getting the ID card, then Tejashwi’s voting rights may be temporarily suspended. If the second voter ID card is found to be fake, Tejashwi may be sued.
Before the upcoming assembly elections in Bihar, this dispute has brought a ‘opportunity’ for Tejashwi’s opponents. Earlier, all the opposition parties including RJD, Congress were targeting the Election Commission and the ruling party regarding the process of SIR. But now the wind has vomited, because now a party like JDU-BJP is surrounding Tejashwi for two voter ID cards.
How can we survive stunning?
If Tejashwi proves to the Election Commission that the second EPIC number (Rab2916120) was accidentally or due to technical flaw, and he did not use it, he can avoid legal action. However, in the press conference, the RJD leader himself claimed that he had voted with this ID card in the last Lok Sabha elections.
If he can claim that the second voter ID is old or deactive, and he did not use it. However, the Election Commission has said that this number was not found in the record of the last 10 years, which takes the needle of suspicion towards Tejashwi. Now Tejashwi will have to make it clear in response to the notice of the Commission, where the second EPIC number came from. Also, to avoid action, one has to give satisfactory answers.
If a common citizen accidentally has two voter ID cards, then the Election Commission should be contacted to avoid legal trouble. Such a person should immediately contact the nearest Electoral Registration Officer (ERO) or Booth Level Officer (BLO) and give information about two cards. Form 7 (to remove names from the voter list) should be filled and an appeal should be made to remove a voter ID. This can be done both online or offline.
