Indore bench of Madhya Pradesh High Court dismissed a petition filed against the transfer of an employee of the state measurement department."Text-Align: justify;"> The court said that if such baseless allegations were accepted for consideration, it could create a situation of chaos in the government machinery. & NBSP; Nasimuddin, who was in charge of the measurement department in Ratlam, was transferred to Chhindwara on March 13. Nasimuddin filed a petition in the High Court against the order of transfer.
What was said in the petition?
In the petition, Nasimuddin called this order malicious and said that his transfer is ‘inspired by politics’ and he was shifted only at the behest of a local leader of the ruling Bharatiya Janata Party (BJP) because he belongs to the Muslim community.
Sarkar bid- Forcibly giving communal color
These allegations of Nasimuddin were dismissed by the state government during the debate in the High Court. The state government counsel said in the court that the petitioner has filed a petition against the transfer order to take undue advantage of his religion and the general order of transfer is being given communal color.
The state government’s counsel also argued that if four people of a community have been transferred, it cannot be considered a transfer done with malicious intentions. & Nbsp; High Court Justice Subodh Abhyankar dismissed Nasimuddin’s petition on March 28 after considering the arguments and facts of both sides."Text-Align: justify;"> The judge reprimanded the petitioner Nasimuddin
Single bench said that the petitioner posted in Ratlam for more than nine years could not prove the alleged malicious intentions of the defendants regarding their transfer. There will be a serious obstacle in wearing.
The High Court said, & lsquo; & lsquo; …. and if such allegations (for consideration) were accepted, a senior officer of the Muslim community may be affected by criticism of communal discrimination by issuing orders for transfer of their subordinates of their subordinates to the non-Muslim community tomorrow, as a result the government machinery may fail completely which may cause disorder. Therefore, such a trend should be discouraged in the beginning. & Rsquo; & rsquo;
