Chief Justice (CJI) BR Gawai of the Supreme Court reached Nagpur on Saturday to attend the honor ceremony organized by Nagpur District Counsel Association. During this time he became emotional after remembering his father. He said, ‘My father always felt that I would one day become the Chief Justice of the Supreme Court. But today when that dream is fulfilled, he is not in this world to see it.

CJI Gawai gave his speech in Marathi during this period. He said, ‘Have anyone read my speech of Oxford? I said in it that judicial activism will remain permanently. This is necessary to protect the Constitution and ensure the rights of citizens.

‘Limits of the three branches of the Constitution determined’

He said, ‘Also, I am in favor of the idea that the Indian Constitution has set the boundaries of its three branches- legislature, executive and judiciary. Making law is the job of the legislature. Whether it is Parliament or various state assemblies. The executive is expected to act according to the Constitution and the law. When a law is made out of the border of Parliament or Assembly, and it violates the principles of the Constitution- then the judiciary can interfere in it.

‘The judiciary should not interfere in every case’

However, he also said that the judiciary should not interfere in every subject. The CJI said, ‘If the judiciary tries to interfere in the field of executive and legislature in every case, then I always say- judicial activism is necessary, but it should not be allowed to convert into judicial adventurism and judicial terrorism.

CJI Gawai became emotional on this occasion. He said, ‘My father also used to say that I will one day become the Chief Justice of the Supreme Court. But they did not survive to see this. He died in 2015. They are missing. I am happy that my mother is present here to see this moment.
