Former Congress MP Nachiappan supported the elections simultaneously.
Former Union Minister and Senior Advocate EMS Nachiappan has told the Parliamentary Committee on One Nation One Election that there is no need to amend the Constitution to hold the Lok Sabha and Assembly elections simultaneously. Rather changes in the Representation of the Public Representation Act can be legally enough for this.
According to a report by news agency PTI, former Congress MP Nachiappan spoke to JPC. He said that the government should consider implementing this proposal in the current term as it would be legally suspicious to leave its notification for the next Lok Sabha.
Former Congress MP, BJP’s P.P. Questioned some provisions of the Constitution Amendment Bill, which proposed to hold elections simultaneously before the Joint Committee of the Parliament headed by Chaudhary. After the meeting, Chaudhary said that the next JPC meeting is likely to be held on July 30.
Former MP’s arguments and suggestions
- Nachiappan cited the principle of temporary boundaries on the legislative mandate to object to the provision of the proposed law, stating that after the passage of the bill, the President can implement the provision of this article with a public notification issued on the first meeting of the Lok Sabha after the general election and that date of notification will be called the fixed date.
- He has argued that the newly elected Lok Sabha is the latest expression of the will of the people and cannot be asked to follow the instructions of the previous House.
- He said that the Constitution does not talk about holding separate elections simultaneously, so there is no need to amend it. The Constitution has ordered the Election Commission to complete all the duties related to the election.
- Nachiappan claimed that amendment to sections 14 and 15 of the Representation of the People Act, not only six months before the date of dissolution of any MLA, but also gives the right to notify elections within the next few months of disintegration, which will help to hold the dates of assembly and Lok Sabha elections simultaneously.
- Elections of Lok Sabha and Assembly can be conducted in some electoral cycles not at once, but by this process.
- The BJP and its allies are in power in about two-thirds of the assemblies. This alliance, which also rule the country, can take a big jump towards implementing elections together by agreeing to hold elections for the Lok Sabha as well as the assemblies.
Former CJI Chandrachud reached the meeting of July 11
The Joint Parliamentary Committee headed by BJP MP Chaudhary is talking to jurists and law experts to prepare its recommendations on the bill. Former India’s CJI JS Khehar and DY Chandrachud held talks during the 8th meeting of the committee on Friday. In the next meeting, Justice Rajendra Mal Lodha and Justice Sharad Arvind Bobade can be called to express their views.
Big things about the meeting of Chairman Chaudhary …
- The committee is very seriously discussing the issue and many legal giants, including former Chief Justices of India, have given their views to help understand whether this idea fits into the constitutional structure.
- The whole country should feel that JPC has listened to everyone, everyone’s views have to be known. If the members feel that there is a need to listen to people before presenting the report, then we can ask for more time from Parliament.
- There is no hurry to submit the report as the opinion of all stakeholders should be heard. We have interacted with four former Chief Justices and solved all doubts. The conversation focused on whether a nation, an election bill is in line with the Constitution.
- We are very happy that all the members discussed for five hours, so that we can enact the right law and make concrete recommendations when this law goes to Parliament.
