The petitioner alleges that Rahul has British citizenship. On this, the High Court sought an answer from the government. After this, the Central Government had written a letter to the UK government and sought information. The UK government confirmed in July that the related information was sent to the Government of India through the Indian Embassy.

What is the case of Rahul Gandhi’s citizenship?

On July 1, 2024, Karnataka lawyer and BJP leader S.K. Vignesh Shishir filed a petition in the Lucknow bench of the Allahabad High Court. In this, he alleged that Rahul Gandhi had British citizenship.

The petitioner claims that Rahul, while being a director in a UK company, described himself as a British citizen. He has demanded the cancellation of Rahul’s citizenship under Section 9 (2) of the Indian Citizenship Act 1955.

On December 19, 2024, a bench of Justice Rajan Roy and Justice Om Prakash Shukla directed Additional Solicitor General (ASG) Suryabhan Pandey to get information from the Union Home Ministry. The Ministry of Home Affairs had told the High Court that they have written a letter to the UK government.

This was followed by a hearing on 24 March. Justice AR A division bench of Masudi and Justice Ajay Kumar Srivastava directed the state government to file a status report in four weeks. The government had sought 8 weeks.

The case was again heard again on 21 April. The High Court had asked the Central Government- or not to reply on whether Rahul Gandhi is a British citizen or not. The court had said that the matter is of national importance and the delay in it would not be acceptable.

A similar petition was dismissed in the Supreme Court in 2019

In 2019, the Supreme Court dismissed Rahul’s petition related to Indian citizenship. The then Chief Justice Ranjan Gogoi had said that if a company mandates Rahul Gandhi as a British citizen in a form, did he become a British citizen only by doing so.

A bench of CJI Gogoi, Justice Deepak Gupta and Justice Sanjeev Khanna had said- ‘We dismiss this petition. There is no basis in this. “The petition stated,” The court should direct the Ministry of Home Affairs to take a decision on Rahul’s citizenship. “

The petition also demanded that Rahul Gandhi be disqualified from contesting elections. Petitioner Jai Bhagwan Goyal mentioned the UK company’s annual details of 2005-06. In this, Rahul was reportedly described as a British citizen.

Rahul visited the village of Boolgarhi in Hathras on December 12, 2024.

3 cases against Rahul in UP

  • A defamation case against Rahul is going on in the civil court of Sultanpur. This case is of 2018. In which BJP leader Vijay Mishra accused Rahul of defamation. The hearing of the case has been postponed several times and now the next hearing is on 28 April.
  • A case has also been registered in a Lucknow court due to a controversial statement on Rahul about Veer Savarkar. In this case, Rahul Gandhi was also fined 200 rupees and was ordered to appear in court personally on 14 April. But did not appear.
  • The hearing in the ongoing defamation case against Rahul in the MP-MLA court of Hathras will be held on April 24. Ramkumar alias Ramu of Bulgarhi village has filed this complaint. It is alleged that the youth who were convicted from the court were accused of gangrape.
