Actor Saif Ali Khan, his mother Sharmila Tagore and Pataudi family have suffered a major setback from the Jabalpur bench of Madhya Pradesh High Court. On the petition related to the succession of the property of the last Nawab Mohammad Hamidullah Khan of the princely state of Bhopal, the High Court has canceled the order passed by the trial court in the year 2000 and directed to re -hear the case.
In fact, a single bench of High Court Justice Sanjay Dwivedi has clarified that the trial court had rejected the petition only on the basis of the pre -Allahabad High Court’s decision without considering all aspects of the case. It was also said that the Supreme Court had rejected the Bhopal Throne Succession Act 1947 after the merger. In such a situation, the decision of the trial court was incomplete and legally flawed. The High Court has directed to complete the hearing of the case within a year.

‘Recognition was received as private property’
The case is related to the succession of his personal property after the death of Nawab Mohammad Hamidullah Khan (4 February 1960). Significantly, the princely state of Bhopal in India was merged on 30 April 1949 and under the written agreement, the Nawab’s privilege and ownership of private property were upheld. The Government of India issued a letter on 10 January 1962, recognizing the property of the Nawab as a private property under Article 366 (22) of the Constitution.
‘Dismissed based on a prior decision’
The plaintiff, including Begum Suraiya Rashid, Begum Maihar Taj, Nawabjadi Qamar Taj Rabia Sultan and other successors. He claimed that the property of the Nawab should have been divided according to the Muslim Personal Law. He had applied in the trial court demanding property sharing, which was rejected by the trial court on the basis of a prior decision of the Allahabad High Court.
‘Trial court will now hear again’
Against this, the plaintiff filed two appeals in the Madhya Pradesh High Court in the year 2000. In this decision of the High Court, Nawab Mansoor Ali Khan Pataudi, his wife Sharmila Tagore, son Saif Ali Khan, daughters Saba Sultan and Soha Ali Khan were made Annaven. Now the trial court will hear this property dispute again. In this, the arguments of all the parties will be heard afresh. The matter is very sensitive to legal and politically, as it includes many complex aspects such as the rights, succession laws and definition of personal property of former royal families.
