The petition of Shiv Sena (UBT) leader Uddhav Thackeray will be heard in the Supreme Court today. Uddhav has appealed to Thackeray that he should be allowed to use the name ‘Shiv Sena’, ‘Dhanush-arrow’ election symbol and tiger saffron flag. This demand has been made for the elections of Municipal Corporation, Municipal Council and Nagar Panchayat to be held in Maharashtra.

Uddhav’s lawyer Devdutt Kamat demanded a quick hearing on this in front of the Supreme Court bench working during the holidays on 2 July. He said that the Eknath Shinde faction should be prevented from using these signs, as it is the identity of the real Shiv Sena and the public sees them emotionally.

In 2022, Eknath Shinde’s faction rebelled from Shiv Sena. After this, in February 2023, the Election Commission gave the name ‘Shiv Sena’ and its sign to the ‘Dhanush-arrow’ Shinde faction. Uddhav Thackeray has challenged the decision in the Supreme Court and the matter is still going on.

Demand for Uddhav faction- permission to use symbols If the local elections are close, the Uddhav faction wants the court to give a temporary (interim) verdict, so that they do not suffer losses in the elections. He suggested that in the NCP dispute, the court allowed Ajit Pawar faction to use the symbol, so can be done here as well.

Shinde faction counsel said that the Lok Sabha and Assembly elections have already been held with the same name and sign and the Supreme Court has previously refused such demand of Thackeray.

Earlier, the court had ordered to hold a long -stayed local body elections in Maharashtra, which is now to be completed within 4 months.

  • Shiv Sena leader Eknath Shinde rebelled from the party in June 2022. After this, Shinde formed a government in the state with the BJP and became the Chief Minister himself. Shinde then claimed his claim to Shiv Sena. The Thackeray faction alleges that Shinde unconstitutionally seized power and is leading the unconstitutional government.
  • On 16 February 2023, the Election Commission accepted Eknath Shinde faction as the real Shiv Sena. At the same time, Shinde faction was allowed to use Shiv Sena’s name and sign (arrow-man). The Uddhav faction challenged the Election Commission’s decision in the Supreme Court. The Supreme Court had asked Speaker Rahul Narvekar to decide on this.
  • On 10 January 2024, Rahul Narvekar described the Shinde faction as the real Shiv Sena. On behalf of the Thackeray faction, Kapil Sibal filed a petition in the Supreme Court on behalf of the Thackeray faction. On 22 January 2024, the court issued notice to all rebellious MLAs including Shinde.
