In fact, on January 26, 2018, a person named Chandan Gupta was murdered during the Tiranga Yatra in Kasganj, UP. Now after 7 years the court has given its verdict. The court named Azizuddin, Munajir, Asif, Aslam, Shabab, Saqib, Aamir Rafi, Salim, Wasim, Naseem, Bablu, Akram, Taufiq, Mohsin, Rahat, Salman, Asif, Nishu, Wasif, Imran, Shamshad, Zafar, Shakir, Khalid. In the Kasganj murder case, the accused used many legal tricks to avoid punishment. When the trial of the case started in 2022, the victim’s family in Kasganj could not find a lawyer to represent them. The victim’s family applied for case transfer in Lucknow High Court, on which the case was transferred from Kasganj to Etah for trial. Section 124A of treason was imposed in the case, due to which the case was transferred to the NIA Special Court of Lucknow.
Accused Naseem had filed a petition in the High Court
After this, in March 2022, the case was transferred to the NIA Special Court of Lucknow and the trial started. During the trial, the prosecution presented 18 witnesses while the defense presented 23 witnesses. After years of testimony and cross-examination, when the trial was completed and the verdict came, accused Naseem Javed filed a petition in the Lucknow bench of the High Court, questioning the legality of the court.
Earlier the decision was to come on 25th October
In the petition, accused Naseem Javed said that Section 124A of treason should be imposed and the investigation and hearing should be conducted in NIA court without NIA. Along with this, the seniority of the hearing judge Vivekanand Sharan Tripathi was also challenged. However, the Lucknow bench of the High Court rejected the petition of Naseem Javed. Earlier, the NIA special court was going to hear the verdict on October 25. But when the petition was filed in the High Court, the decision was postponed for 2 months.
The accused party also reached the Supreme Court
On Thursday, when the decision was to come in the NIA special court, an application was again filed in the Supreme Court on behalf of Naseem Javed. In the Supreme Court, Justice Vikram Nath and Justice Prasanna B Varale also rejected this petition of Naseem Javed. After this, today on Friday, after 6 years, 11 months and 7 days, the NIA court sentenced 28 culprits to life imprisonment in the Chandan Gupta murder case.
And today we have got justice: Chandan’s family
After the court’s decision, Chandan’s family expressed satisfaction at getting justice. While talking to the media, Chandan’s father said that Chandan’s soul will be very satisfied today. We had full hope of getting justice and today we have got justice, but at this moment we are missing our son very much, we are missing him a lot.
Chandan’s brother Vivek told Aaj Tak that today is a big day, my brother’s soul must have rested in peace. My brother was brutally murdered in our own country. The government had cooperated a lot in fighting our case. Referring to the day of the incident i.e. 26th January 2018, he said that on that day, Tiranga Yatra was being taken out, then our bikes were stopped in Badunagar, everyone was beaten fiercely, from there we somehow managed to save our lives. After being saved, we reached near Salim’s house, there Salim and other people shot my brother Chandan. After this we took Chandan to the hospital, where the doctors declared him dead.
This was the whole matter
According to PTI, on the morning of 26 January 2018, Chandan Gupta and his brother Vivek Gupta had participated in a Tiranga Yatra. A government lawyer said that when the procession reached the gate of Government Girls Inter College on Tehsil Road, a group including Salim, Wasim and Naseem blocked the road and stopped the procession. The lawyer told that when Chandan protested, the matter worsened and stone pelting started from the accused side. He told that Salim, one of the main accused, shot Chandan, seriously injuring him. Despite being seriously injured, Vivek and his companions took Chandan to Kasganj police station, from where he was immediately taken to the district hospital, where he was declared dead shortly after arrival.
