The Supreme Court said on Tuesday that if the drivers on the highways intend to stop in the middle, then they must give a warning indicator to the vehicles running behind them. The court has convicted the accused car driver while delivering the verdict in one such case. Which stopped the vehicle without any pre -indicator (indicator) during driving on the highway. Due to which a motorcycle driver had to lose his left leg in a road accident in Tamil Nadu in 2017.
A bench of Justices Sudhanshu Dhulia and Arvind Kumar said on Tuesday that a driver can not be justified by a driver suddenly stopping the car in the middle of the highway, even if it is a personal emergency situation. Justice Dhulia said, “The high speed of vehicles on the highway is expected and if a driver intends to stop his vehicle, it is the responsibility to warns or indicate other vehicles running on the road.”
What is the matter?
The court has given this decision on the petition of engineering student S Mohammad Hakim. On January 7, 2017, Hakim was going somewhere on a motorcycle with his friend in Coimbatore. On the way, the car running in front of them suddenly stopped and his bike collided with the car and fell to the right side. Meanwhile, a bus running on the road passed over their foot. In this painful road accident, Hakim’s left leg had to be cut during treatment.
What did the court say?
During the hearing of the case, the bench said that, “It is true that, the appellant was negligent in maintaining enough distance from the moving vehicle and run a motorcycle without a valid license.” However, the bench clarified that it cannot be ignored that the root cause of the accident was suddenly braking by the car driver. The bench said, “The explanation given by the car driver to stop the car suddenly in the middle of the highway is not appropriate from any point of view.”
In this case, the car driver who had a sudden brake on the highway had argued that he was traveling in a car with his wife and since his wife was pregnant at that time and he felt vomiting, he suddenly stopped the car. But the court did not agree with this argument and the car driver was convicted for up to 50 percent for the accident.
