The Supreme Court has refused to intervene in the case of Samajwadi Party’s district office being vacated in Pilibhit, UP. The court’s vacation bench has said that in 2020, the then District President of SP had withdrawn the petition from the High Court. If the party has to say anything, then go to the High Court.
What is the matter?
In 2005, the residence of Executive Engineer of Pilibhit Nagar Palika Parishad was given to Samajwadi Party on a minor rent as the Samajwadi Party government in the state. The party made it a district office. On 12 November 2020, the Nagar Palika Parishad revoked the allocation against the rule. Despite this, the party did not give up possession. Now the action to vacate the place has been started.
District President withdrew petition
Samajwadi Party’s then District President Anand Singh Yadav filed a petition in the Allahabad High Court against the cancellation of the allocation. The High Court asked him why he did not go to the district court. On this, on 1 December 2020, Anand Singh Yadav withdrew the petition from the High Court, but after this no petition was filed in the district court on behalf of Yadav or Samajwadi Party.
What happened in the Supreme Court?
The senior lawyer appearing for the Samajwadi Party told the Supreme Court that Anand Singh Yadav had moved from the post of District President of the party shortly after the High Court order, so he could not file a petition as the president. On this, a bench of Justices Sandeep Mehta and Justice Prasanna Varale said that the party should have taken appropriate legal steps in the case. Now after so long you have reached the Supreme Court.
