Supreme Court Bemoans Lack Of Toilet Facilities: The Supreme Court has directed to make separate toilets for men, women, disabled and third gender in all the court complexes of the country. The Supreme Court has asked all the High Courts to ensure compliance with this order in their respective states. It has also been said in this order that the state governments should provide appropriate funds for this work.
Giving order on the petition of Assam-based lawyer Rajib Kalita, the bench of Supreme Court Justices JB Pardiwala and R Mahadevan said that availability of clean toilets is a basic human right. It is very sad that there are a large number of such courts in the country where there is a severe shortage. In many places in rural areas, even a proper toilet is not available for a judge.
‘It is the right of every citizen to seek justice’
The court said that it is the right of every citizen to seek justice. That’s why he comes to the court. The absence of toilet facilities as per the number of people coming to the court is a hindrance in the process of justice. This cannot be ignored. Apart from men and women, there should also be adequate toilets for third gender and disabled people in the court premises. Their cleanliness should also be taken full care of.
‘Toilet facilities should be as per the needs of children’
The Supreme Court has also said that children also come to the family courts. There should be toilet facilities in their premises as per the needs of the children. For women to take care of their newborn babies, such a place should be created like in the airport. Apart from this, the Supreme Court has given many instructions.
‘Representative of Bar Association should also be kept in this committee’
The Supreme Court has asked all the High Courts to form a committee within 6 weeks to ensure further action as per this order. The Chief Justice should nominate a judge to chair this committee. Apart from the Registrar of the High Court, Chief Secretary of the State, PWD Secretary and Finance Secretary, a representative of the Bar Association should also be included in this committee. This committee should make a plan to develop adequate toilets in all the court premises after assessing the number of people coming every day and get it implemented. The Supreme Court has asked all the High Courts to file a progress report in this regard within 4 months.
