The Supreme Court has directed the petitioner to appeal to the High Court, dismissing the contempt petition filed against Uttar Pradesh officials. The petitioner says that the Supreme Court’s order of November 13, 2024 has been violated, in which the action of bulldozers in the country has been banned without giving notice or hearing.
Justice Bhushan Ramakrishna Gawai, a bench of Vinod Chandran of Justice has asked the petitioner to appeal to the High Court. The petitioner says that the demolition action was taken on his property on his property in Sambhal on January 10 and 11, 2025 and for this the administration neither informed nor sent any notice, while the Supreme Court in November This kind of action has been banned.
Earlier on 24 January, the court deferred the hearing for a week. The petitioner’s counsel had requested to postpone the hearing citing the unavailability of the argument. Petitioner Mohammad Gayur had filed a contempt petition against Uttar Pradesh officials, saying that action was taken on his factory in Sambhal. The petition claimed that this factory was the only source of income for him and his family and this action of the authorities has threatened his and his family’s life.
On 13 November last year, the Supreme Court issued guidelines for the country while hearing the petitions filed against bulldozer action. It was said that no such action should be taken without any cause notice and 15 days time should be given for reply.
The court passed many more instructions in the order and made it clear that these guidelines would not apply to unauthorized structures that are present with any public place like road, street, pavement, railway line, river or water bodies. Nor will they be applicable in cases in which the court has ordered demolition.
