The Supreme Court has said that when the road is not worth driving, then the recovery of the toll on it is wrong, which is incomplete, in which the road is incomplete or in which the traffic is stuck, the toll should not be charged. The Supreme Court has upheld the order of the Kerala High Court in which the toll recovery was stopped at the Paliakkara toll booth in Thrissur district.
On August 6, the Division Bench of the Kerala High Court ordered to fix the road for 4 weeks due to the poor condition of Edpalli-Munthi section of National High Way 544 and to fix the road for 4 weeks. In this section of 65 km, the National Highway Authority (NHAI) and the company responsible for maintaining the road and toll recovery against the prohibition on toll reached Supreme. He said that there is a very limited part of the road.
Refusing to change the order of the High Court
The bench of Chief Justice BR Gawai and K Vinod Chandran has refused to change the order of the High Court. During the hearing, the court said that the poor condition of the road and the jam there were cited. The court had said that the road on which the distance of 1 hour is being fixed in 12 hours, why should it be allowed to recover toll? Why should people pay 150 rupees to walk on such a road?
What was the order of Kerala High Court
The Supreme Court has agreed with the Kerala High Court’s comment in which the High Court said, “It is true that people are bound to pay toll charge to use the highway, but NHAI also has the responsibility to ensure smooth traffic without obstruction. This relationship of public and NHAI is bound by confidence. It is wrong to violate the toll duty after taking the support of the people. His agent cannot be given such rights. When people have already taken trouble on the road, they cannot be compelled to give them money.
The Supreme Court has said in its judgment that there are often fewer employees at the toll booth. They have more work. He often behaves like a king. People keep waiting for their turn in a long queue, but no one makes a difference. The engines of the vehicles remain on. Apart from the patience and pockets of the people, it is also heavy on the environment.
