The Supreme Court on Monday said that the Enforcement Directorate (ED) is crossing all limits. Even if it is wrong, the conversation between a lawyer and the client is special. How to issue notices against them. There should be some guidelines.

The Supreme Court expressed concern and displeasure over the action of the ED in which the agency had summoned the lawyers who gave legal advice during the investigation or advocates on behalf of the clients. The court also sought guidelines in this case.

The bench of CJI BR Gawai and Justice of Vinod Chandran was hearing a case related to such actions on the freedom of the legal profession.

The case arose after the ED was summoned by the ED to Senior Advocate Arvind Datar and Pratap Venugopal. The matter was elected by the court itself. The next hearing will be held on 29 July.

SG- We have asked not to summon the lawyers on behalf of ED

On behalf of the government and ED, Solicitor General Tushar Mehta expressed concern over the court’s comment. He said that this issue has been placed at highleval. The investigating agency has been asked not to give notice to the lawyers for legal advice. Mehta said that efforts are being made to discredit the institutions by creating false stories.

Mehta said- As far as the comment is concerned, sometimes they are made incorrectly on the basis of different cases. I am saying this, not ED. There is a conspiracy to create a story against an institution. The court may know the encroachment in some cases.

Attorney General R Venkatramani also said that he had spoken to ED officials. They have been told that sending summons to the lawyers was wrong because the lawyers cannot be summoned to give legal opinion.

Mehta also alerted to form an opinion on the basis of media reports. When Mehta mentioned the accused leaders in the scams, CJI said- we had already said that do not politicize it.

Lawyers raise the issue of freedom in legal profession

Supreme Court Bar Association President Vikas Singh, citing the issue with China and Turkey, said, India should not follow the path of other countries who have attacked the freedom of the legal profession. He said- it should be canceled forever. It is said that in Türkiye, the entire bar association was dissolved. The same case is also in China.

To give lawyers especially legal opinion, calling is setting a dangerous example. Otherwise, it will have a negative impact on the entire judicial system. Lawyers will not be able to give advice independently.

ED also reprimanded in CM Siddaramaiah’s MUDA case

A bench of CJI BR Gawai and Justice K. Vinod Chandran reprimanded the ED during the hearing of ED’s appeal in the Mysore Urban Development Board (MUDA) case.
