The Supreme Court has prohibited the complainant from disclosing the name of the High Court judge and the complaint.
The Supreme Court on Thursday stayed the order of the Lokpal, stating that investigating complaints against the judges of the High Court falls under the jurisdiction of the Lokpal.
A bench of Justice BR Gawai, Justice Suryakant and Justice Abhay S Oka has also issued notice to the General Registrar and the complainant of the Lokpal, taking automatic cognizance.
The court has stayed the complainant from disclosing the name of the High Court judge and the cause of the complaint.
On February 27, Lokpal made the High Court judge accused in his order
The Lokpal was accused of impressing the High Court judge, an additional district judge and another High Court judge in favor of a private company on February 27 in a case.
In this case, the Lokpal had given the verdict that the judge of the High Court would be qualified as a person within the purview of Section 14 (1) (F) of the Lokpal Act.
Justice Gawai said- this is a disturbing thing
Justice Gawai commented on the logic of the Lokpal, saying that it is a disturbing thing. India’s Solicitor General Tushar Mehta said that the interpretation is wrong and did not intend to bring the High Court under the Lokpal.
Justice Gawai and Justice Oka said that even after the constitution came into force in the country, judges of the High Court have been working as a constitutional sentinel. He cannot be considered a legal officer.
