Policemen assaulted Ajit, its video is viral.
The Madras High Court on Wednesday heard the case of Ajit Kumar (27) police custody of the temple guard in Shivganga district. The court had taken notice of itself in this case.
The post mortem report found 44 marks of injury on Ajit’s body. Justice SM Subramaniam expressed surprise at this. He said- This is the cruelty of the police drunk.
Justice said- This is a cruel act, the state has killed its own citizen. It is shocking to see 44 bruises on the body. All parts of his body have been attacked.
Ajit was detained on 27 June in the theft accused. On June 28, his health deteriorated in police custody, died during treatment. The video of policemen dressed in plain clothes went viral.
Ajit’s post mortem report came out on 30 June. The victim’s family accused the police of assault and filed a petition in the High Court. 6 police personnel have been arrested. Shivganga SP has been removed.
Viral footage, in which two policemen are seen assaulting Ajit.
What did Justice say during the hearing…
- Justice raised Ajit’s injury questioning and said- Ajit’s back, mouth and ears were applied to chili powder. His entire body was brutally attacked, causing him to die immediately. Even ordinary killers cannot suffer such injuries. The police have done this together. This is cruelty.
- Some North Indian states, where the literacy rate is low, does not have such incidents. In Tamil Nadu where the government says that we are ahead of everything. How can you allow such an event to happen? States like Tamil Nadu are educationally developed. Such actions are dangerous here.
- This should never happen in any police station. The people of the state are watching this. No one has forgotten the Jayaraj and Benix case. Ajit had no criminal record. Still this happened to him.
Questions raised by court ..
Justice asked the question- How did the special team take over without an FIR in the case of Ajit’s death? At least the team should have added a senior officer. Who recorded evidence from the spot, where Ajit was assaulted. Why were samples of blood and pensions not taken from there.
In response to this, the Tamil Nadu government said that there was no blood and pension on the spot. On this, the court said- If there were no spots, then action will have to be taken against Sivaganga SP. What were you doing without collecting evidence?
Justice asked why no case was registered on the basis of Ajit’s mother’s complaint. Why was a compensation of ₹ 50 lakh to Ajit’s brother and a conversation to give a government job in the wedding hall.
Court asked- where is the assault CCTV
Ajit has been said to be attacked in the bathroom. The court questioned this- Where is the CCTV footage? Was the assault recorded. This can be taken as evidence, as the police action is under question. There is a possibility that evidence may be destroyed over time.
The court ordered that all CCTV footage associated with the case including police station and temple should be preserved. No manipulation should be tampered with, change or destroyed. The footage should be assigned to the judge investigating by June 2.
Justice Subramaniam said that the CBI investigation of the case should be started. Action should be taken against the officers sitting in big positions that cause illegal death. On this, the state government said that there is no objection to handing over the investigation to the CBI. Justice said- State government should tell its stand in writing.
The court directed a judicial inquiry under the leadership of retired High Court judge John Sundarlal Suresh. The Tirubhuvanam police station has been instructed to register a case as per the requirement. The court has asked the state government to submit its report on or earlier July 8.
